what next after initial employment authorization ?

Hello,

Just a bit confused or over the last 2 years of this process. My husband came here on a Fiance visa , we married, completed the I-765 Application for employment Authorization,I-131 application for travel, and his I-485 adjustment of status everything went as plan and he received his biometrics appt within a couple of weeks. Then he received his Authorization to work card and he was able to obtain a SS card . We just received notice that his interview may be waived....but here is my question. When I looked at his Authorization for employment card I see that it only is valid for 1 year!! what now? I'm confused and not sure what we need to be doing next to insure he receives another one?

Any insight would be most helpful!

Agreed with Lainie. You don't need to worry about renewing the EAD/AP card. Getting this is only an intermediary stage for a K1 while the AOS approval is pending, as some may take 4 months to a year in getting the green card.

There's only been a few cases reported here that requires a K1 a need to renew it, and that's when the green card is not yet received after a year of the EAD/AP approval.

thanks for the replys ! this is so appreciated....so the card he received with his photo the Employment Authorization Card. Is that not the "green card"?

No, not at all. It is an Employment Authorization Document (EAD). It is the result of filing I-765.

The main thing, the Greencard, is from I-485, and has not been approved yet.

The EAD is meant to be a stop gap measure so he can work while the Greencard is processing.

Once his Greencard is approved, he will become a Legal Permanent Resident (and not before). Keep in mind that the Greencard will expire in two years and he will need to file form I-751, Removal of Conditions, and show again that the marriage was not entered into for the purposes of evading immigration law.

IF the GC is not approved/delivered before the EAD expires then there is a way to renew the EAD. Sorry but I do not know those steps. Hopefully there won't be a need for that. Good luck.

I read that if a renewal of the Employment card is needed, then do this in plenty of time - 3 months ahead of the expiry, as they can take a while. Hopefully by the sounds of things, that won't be necessary - But it's something to bear in mind if you haven't received the Green Card within 6-9 months for any reason :)
