Hi Visa Journey,

My fiance and I had our K1 petition expire in May. K1 made it to the Consulate. :\

Now that we are reevaluating our options to bring her and her 2 daughters to the USA, we think it might be better to get married in Mexico.

The plan will be to marry in Mexico and then when I return to the USA I will submit the prepared CR-1 package(s).

I have read the guides and part of the documention to be provided as proof of an on going relationship are items indicating we are living together and have joined finacial accounts.

We will not be living together and I don't see us creating financial accounts prior to her entering the USA.

Is this going to be an issue? Is this where the K1 process maybe better?

If I understand correctly, once married I will have a step parent relationship with her 2 daughters which appears I will fill out an I-130 form for each child, plus any documents that prove I can support them financially. Is this correct?

Thanks in advance for your help!!!

They aren't expecting co-mingling of finances for people who don;t live together.

Your communications, Facebook, email, text, phone logs, cards, letters, all the boarding passes, Visa stamps in passport showing you communicate will suffice. Showing you have a bonafide relationship.

Most of us can not add our spouse to anything until we have a SS# so that's no issue.

Also yes you will fill out a I01309 for each person immigrating. The Affidavit of Support (I-864) comes later down the road at the NVC stage (thats after your approval ay USCIS).

For a person bringing over a parent and kids to me married says commitment don;t know how hard your embassy is

I-130 for each intending immigrant. When reading the I-130 instructions, anything that appears after the words, "in addition to the required....." is not required. If you have some of it, provide it. Usually newlyweds have evidence that fall under last listed category, called "any other".

You'll probably be assisted by bearing in mind the forms and instructions were written and/or vetted by attorneys writing so other attorneys could understand them. As such, each word and phrase has meaning, so read carefully and do your best to interpret literally. The instructions were never written with the idea of the general public reading and following them. Many can and do, but that was never the intent.
