Hello. I've been posting a lot of questions and I have another question now. I really really appreciate those people who finds time to answer and giving suggestions.

I arrived in the US Sept. 2013, got married within 90 days. Never filed for AOS as my husband became disabled. Most people say we can't file for AOS if my husband is unemployed. We are still waiting for determination of our application for Social Security Disability which can be consider as an income. Right now obviously I am out of status. We wanted to file for AOS but we can't as Affidavit of Support is required. So as of now, I am wondering if there is any way I can change my name into my married name aside from filing for AOS? I am pregnant, if I don't have my name change by the time the baby is born, will he/she be able to use my new last name ( husband's last name ) even if I haven't change mine?

We are really sad we can't file for AOS yet, though we have the money for filing.

Your name was changed when you married. At that point you have the choice of using your married name or your maiden name. I assume the only ID you have is your passport in your maiden name. That plus your marriage certificate would be legal proof of you having his last name. In most if not all states you can give the child whatever name you wish. It does not have to be your last name, his last name, or anyone's last name, you can make one up.

Off your main topic. You are pregnant and your spouse has no income. How are you paying the medical bills?

Yes, I only have my passport as ID. I have an insurance which covers medical check ups. We have savings for other stuffs.

belinda answered your name question about as well as it can be answered.

As for the Support documentation for the Adjustment of Status....Have you considered someone as a co-sponsor? Not sure if that is feasible in your situation, but it is one way of adjusting status before your spouse meets the requirements.
