Ahhhh!

Recently, my fiance in US got injured at work, possibly needing a surgery. He'll be out from work for awhile (not to mention all the medical bills to come), and I've been trying to look for potential cheap flight tickets that I can afford to visit him and help out with things, but inexpensive Summer travel tickets are extremely hard to come by, especially since I need the return ticket also, as I hear they can refuse to let me enter the country without one. While trying to see if there's any hope of getting our NOA2 anytime soon, I came across a forum post about expediting the process! Is there any chance that this could be an adequate reason for expediting the process? (I also don't get what they mean by financial loss in the expedite criteria? Is that limited to financial loss somehow caused by delayed process, or just any circumstance?) He is also going to be out(unpaid) for another week or two in the winter when the business is slow. I feel guilty even thinking about this, while there are lots of people waiting for their approvals patiently, but it breaks my heart, when I think about my fiance. Ahhhh help! Any feedback would be great! Thanks, guys!

How long have you been waiting at TSC? Please fill out your timeline!

It's certainly worth a shot, you'll need evidence like letters from his doctors saying he can't work etc. How long will he be out of action for? If it's just a few weeks then I don't know how successful you'd be...

  • Severe financial loss to company or individual

does that mean loss on the beneficiary's, or the applicant's side? or either?

And what kind of loss are they talking about? Loss relating to delaying of visa process or just any misfortune? The criteria seem very ambiguous...

It's the financial loss for the petitioner.

It's designed to be ambiguous so they have the freedom to make a decision. All you can do it file with lots of evidence and cross your fingers!

I'm not sure how your expediting a K-1 visa would help out with his financial loss. He still won't be able to work with you there or not. You won't be eligible to work until you file for AOS and receive your EAD. You won't be able to file for AOS without an affidavit of support.

Then again it costs nothing to try.
