We are waiting for NoA2. My husband included his certificate of citizenship and US passport in the i-130 that we sent.

I just realizrd that on his COC which was given to him in 1997 when he was only 13 years old has the incorrect birth year. This certificate was signed by his mother. However, his US passport has his correct birth date. I'm anxious this would cause delays in our petition.

Should he file a replacement of his certificate while waiting for noa2?

Thanks guys! :)

I'm guessing the date of birth on your paperwork matches the passport. If so, you'll probably get an RFE for it not matching the birth certificate. Maybe not, it might slip by. Doubtful, though. I did something similar on my K-1 application, they spotted it and I got an RFE. Had to send them a copy of correct birth certificate.

We put his correct birthdate in the i-130 form, and yes it matches the passport. Our concern is his certificate of citizenship(form n-560) has the incorrect birth year. Month and day are correct. He is a naturalized citizen, so we did not submit his birth certificate because he wasn't born in the US.

Thanks!:)

Btw, i-130 form, his passport, and his birth certificate (which we did submit to USCIS) have the correct birth date. Should he file a replacement to amend his certificate of citizenship while we are waiting for noa2? Thanks.

Thanks! I think I read that it might take about 6 months to get the amended certificate, is this true? Do you guys think the error in his certificate will cause delays in our petition?

Thanks for your help!

You only needed to send the entire passport OR the naturalization certificate. You did not need to send both to prove US citizenship.

I would get the certificate corrected but try not to worry about it to much as he obviously has a US passport.

An RFE will cause a delay. IF you get one. My delay is 2 weeks and counting.

I hope we don't get an rfe for that coz it would take months for us to get the amended certificate.

Yeah, that's what I told him but he still included his certificate. Lol.

Thanks, I feel relieved to hear that. Hopefully our application will push through without RFEs for that. Btw, if he applies for a replacement, can we request it to be expedited or something? Thank you so much!

I'm not sure. He'll have to check it out. It's not an issue I've had to deal with.
