Hello:

I just called the UCIS office and they informed me that my k-1 visa petition was rejected because I used an old 129 form. I had the form since last year and used an older version. Now the problem is i am waiting for them to send me back the packet and my 2 years have passed since i got engaged to my fiance. Will they accept a new file that i submit and tell them the reason for this? Should i be worried?

Please if anyone has any type of experience with this, keep me updated.

Have you met your fiance in person over the last 2 years? If so then you'll be fine to refile, it doesn't matter when you got engaged as long as you've met up.

that 2 year mark has passed. i went overseas in may 25 2012 . What you think of the situation now?

One of the requirements for filing the I129F is that you've met up in the 2 years previous. As this has now passed you'll have to meet up again (and keep lots of proof) in order to refile.

The only exceptions to meeting up are extreme hardship (for the US citizen) or cultural issues. It would be much easier to simply meet up again.

Don't bother with the motion for re-consideration. It has been discussed here a couple of times already that such appeals will only take longer and will just delay you further with a very low possibility of success, if any.

As advised above by Bunnygirl and Zedayn, it will be definitely easier and faster for you to re-file (using an updated uscis form) after meeting face to face again.

Man, I was the fiancee, I would be kid of hurt you would not want to come see me.

Please keep in mind that some dates are only known after receipt of another document.
For example, the USPS Form 3811. The stamped receiving date was not know until the original Form 3811 was received on 07/13/2013 1:30 p/m CST.

Refile. We are actually July 2013 filers and got denied last December 2013. Fiancé sent again the 129f last Feb2014. And now my interview is quite approaching. :dancing::dancing::dancing: If I were you don't waste time now.

This is very clear cut, YOU and your fiance must show you have met, (within the last 2 years) and show ""plenty"" of proof that you did, this is bad luck, but it goes with the way USCIS works! You have no other way to get a K-1 approved, you have already wasted many months for, nothing! Do the right thing!

You have to have met with your fiancé, in person, within the last two years of filing the petition. You will also need a more recent letter of intent from your fiancé. Sounds to me like a trip is in order. Also, ALWAYS go to http://www.uscis.gov/ in order to obtain the most up to date information and forms.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

You HAVE to meet again...before you file any new petition...regardless of any reason the first petition was denied.

You MUST meet again.
