Hi all,

Our predicament is this: wife is French, living in Montreal on a work visa (expires 08/06/14), and we're hung up in NVC with the DS-261. Unless there is a miracle, she is not going to get an interview date before her work visa expries. We had requested her file be processed in Montreal.

So, if she is not given an interview date before 08/06/14, what are our choices:

can she leave and come back under a tourist visa and still be interviewed?

IF SO, what is the shortest amount of time between medical examine and interview date allowed (i.e. if she flies back, she will need to get the medical and interview done in one trip. Is there a requirement, formal or practical, between these two dates. I believe SASHY had 5/28-6/3, which is doable)

OR

should we change interview/processing location back to France? (and restart NVC since Paris does not allow EP)

We have asked NVC and they said ask Montreal, and when asked, Montreal said “ask NVC”.

Any and all help is appreciated.

On an entirely differnet note, any ideas or links to other posts on delayed DS-261? We filed choice of agent form on 5/8/14, and it is still not processed. We paid and sent in AOS on roughly 5/10/14, but cannot proceed with IV fees and DS-260 until they process the 261. When I call they simply say 'we know nothing, wait the 30 business days, and call back.'

You must be a legal resident to interview in a country. I don't know what the current wait for an interview is but consider asking for the package to be sent France. Don't forget the Canadian police certificate

This will not be over quickly. You will not enjoy this.

Yes, I would contact NVC and ask that they reassign the case to Paris. Then, do everything by paper through NVC except the DS261 and DS260. I would redo the DS261 if possible. You are not going to get an interview in Montreal prior to the work visa expiring.

Thank you pushbrk for your speedy reply. We will call today and ask for a reassignment. Hopefully this will not delay the process too much, it has been a long time already... :(
