Yes you can. Different states have differing rules regarding what's needed to get married though. ie waiting period, type of ID required, fees, etc...

Thanks for this.

That's what I thought but just double checking everything as usual. My partners from Massachusetts but we wanted to get married in Florida as his family are there. We studied up on FL state marriage law to make sure it was doable

congrats and enjoy your wedding! Its good to research the specific county in the state to. You don't want to be that far from home and discover you left some required document at home.

Yes, only if you are a heterosexual couple. Gay couples may only marry in 19 states and the District of Colombia currently. They are barred from getting married in 31 states.

On top of the county and/or state required documents in applying for a marriage license as Caryh suggested, you have to check for the "residency" requirements as well. Some counties/states do have this restriction, and some don't, so might as well be very sure before booking your wedding.

Happy wedding planning! :dancing:

There is no residency requirement in FL, and last time that subject came up, the research led to not being able to find any state where you had to be resident of it for so long to get married, except Wisconsin. For Wisconsin, the USC had to have been resident there for at least 30 days, but the non-resident foreign fiance(e) did not need to establish residency for 30 days first. http://www.visajourney.com/forums/topic/379105-traveling-when-k1-visa-is-issued-to-get-married-in-another-usa-state/

For FL, it will also state you need an SSN, like a lot of states do. However, you do not need an SSN to marry. You simply tell them you are a non-resident with no SSN and they will typically use your passport instead. FL has a 3 day waiting period, so you can't get married until 3 days after you apply for the license. Other than that, not really any other requirements for FL. Oh, the license is valid for 60 days, so you need to marry within 60 days of getting the license.

Thanks again. This is the same info I had but great to hear I'm on track..I do have a SSN but plan on bringing everything including the kitchen sink in terms of documentation. We figured the 3 day wait gives us an excuse to have a mini pre honeymoon lol
