But in one of the instruction, i have read that if a person has lived from 3 to 5 years in US and has not been out of US for 18 months, the person is eligible. M confused a bit. Thanks for reply.

If you have been a US citizen for 3 years and he has been married to you for at least 3 years, then he can apply 3 years from the day he became a permanent resident. If either of those conditions don't apply, then he can apply 5 years from the day he became a permanent resident.

In both cases he can send in the application 90 days early.

He is PR only married to me. I m Indian citizen. So it will take one more year...thats final, right?

Yes,he went to US in Sep 2010....came back to India for 2 months...n then returned back to US in April 2013.

You're saying your husband has been here in the US since 2010 and in 2013 left for 2 months and then came back?

I have a hard time understanding you....anyway, as others said since he is a PR, for him it is 5 years if he had his green card since that september 2010.

He is PR only married to me. I m Indian citizen. So it will take one more year...thats final, right?
