hi guys i am new here and i am also confused in which visa to apply for.

Me and my girlfriend are together for 5 years already going 6 years this coming december. i met her through a friend here in the Philippines and we've been having this relationship in the Philippines ever since. I just go in and out of the Philippines to visit my family in US so i've been basically living here for a long time. But now things have changed, I want me and my girl to migrate to the US i don't know which visa to apply for. She also has a 7 year old daughter, but she's not mine but i almost call her mine because she grew up knowing me and made her call me "Daddy".

We plan to leave ahead for a good year and get her after things get situated. We could not bring her also because she is currently enrolled in her school. Do i apply here in the philippines or do i apply in texas cause i live there? Do we get married here or there in the us? i don't have a job in america but i think i'll be landing one soon. Me and my GF have a business online, internet marketing. They pay us through Paypal so we don't have proof of income. just bank statements. proof of billing that i've been a resident here. Can you pls help what would be the best visa for us?

If you're not married you can get a k1 visa assuming you're a citizen. Or get married and file for spouse visa.

You'll need to provide proof of domicile in the United States though

Hi there. I think you should check out the DCF (Direct Consular Filing) option, but from what I read so far here in VJ, DCFs are mostly done for spousal visas. You can probably contact US Embassy Manila to verify if they also accommodate fiance visa petition applications through DCF.

The Financee visa seems like the best option for you. It will take up to 9 months to process from start to Finish so you could plan to bring your "daughter" with you as part of the K1 visa and plan it when she has finished the school term. You can file the petition via mail to the drop box in Texas from anywhere in the world. DCF is also a faster option but you must be a resident of the Philippines to qualify. This calls into question you visa status there and requires proof of residency. There are a couple of challenges that you must overcome. The first is domicile in the USA. K-1s visas require proof that you have domicile in the USA. That means that you live or plan to live (and have made plans to live) in the USA. That can mean a house, bank accounts, a lease and a job in the USA. Do some research about domicile requirements there's plenty of information on the internet. The 2nd hurdle you will face is financial. You will have to prove that you have the ability to support your GF and her daughter. This is proof of income at 125% of poverty line for a household of 3. If you have a job in the USA that pays a salary that meets this requirement it not generally relevant for how long you've held it as long as it is a permanent position and you can get the required proof from the employer although you may need 3 months of pay stubs. Alternatively a self employed individual is looking at providing 3 years of tax documents. However, *ALL* of the financial requirements come near the end of the processs so you can submit the I-129F now as long as you have an address that you can put that your financee and you will live in the USA (perhaps a relative). Also,, do be sure that your GF has never been married as that would be a HUGE hurdle in the philippines Oh, and for the Financial stuff a co-sponsor is also and option.
