So my K-1 status expires June 11th.

As does my current drivers licence.

Do I have any ability to renew and extend my licence expiry date past this while waiting for EAD/GC.

K1 AOS:

May 22nd: Sent away AOS package Day 1

May 27th: Notification via text/email confirming receiving package. Day 5

May 29th: NOA's recieved on 29th May Day 7

June 2nd: Biometrics appointment for June 16th arrives. Day 11

June 16th: Successful Biometrics. Day 24

I think you meant it is your I-94 that will be expiring on June 11th. K1 visa expires at POE. :)

Driving license expires with the validity of whatever immigration document you have. Right now, it's your I-94. You can have it renewed again at DMV when your EAD/AP card or GC arrives, whichever comes first.

I think you meant it is your I-94 that will be expiring on June 11th. K1 visa expires at POE. :)

Driving license expires with the validity of whatever immigration document you have. Right now, it's your I-94. You can have it renewed again at DMV when your EAD/AP card or GC arrives, whichever comes first.

It varies by state, but they look at your current status, so even if you have EAD card, it will expire when that expires

Yeah, we drove from Montana to Vegas for our wedding, and I wanted to drive, so ended up getting a licence which expired in 3 months.

On the plus side, I only had to pay $4 bucks. haha

Every state is different. And you can't assume your I-94 being current makes your foreign driver's license legal in the state you're in.

A quick look over the Montana site makes it appear you'll need the green card to get a license.

Ah a further look it appears the EAD will work there.

This is all dependent on state you live in. But in general the answer is no. By moving here, you are considered a resident of the state where you live. But you're not a legal resident until the federal government says so. As a resident of the state, you have a fixed time period to change your drivers license to a drivers license for the state you've moved to. Then add in later laws enacted to make it hard for illegal immigrants, and they want the federal government to approve your status as a legal resident before you can get a state ID or drivers license.

As an example, California recognizes a foreign DL. However, when you become a permanent resident of the state you have 10 days to get a California DL. Since my wife is in this weird immigration limbo, legally here on her K-1 but not a permanent resident of anywhere (until she gets her GC or EAD/AP), shes been driving with her foreign license.

When she took up residence there, they considered her a state resident and needed to get a Cali drivers license. But they won't give it until she's got legal status here. There was a guy posted in Moving here and your new life in the USA forum on the ticket he got in Cali for this. I think he was from Canada. When he visited from Canada he was fine. When he came as a K-1, it was no longer legal to drive with the Canadian DL.

I don't understand why you cannot drive on your foreign license either.

Its separate laws that are in conflict with each other when it comes to legal immigrants and K-1 holders. One law is who is required to get a new license. The other is who can legally get a license. The first says you legally must get a new license. The second says you can't get one. You'll get charged with breaking the first law if you get caught.

I live in Oregon and my husband was given a temporary 90 day driving license since his I-94 expires the end of this month and we had proof with us that we had filed AoS. They even said that it could be extended another 90 day after the expiration if his combo card hasn't arrived. Not sure what state you live in or their specific requirements but you might want to inquire.
