I am petitioning my father for US residency. He is the only one beneficiary. So we filed out the paperwork back in March, last Monday we took him to USCIS for the fingerprints appointment. Yesterday we got a pink two pages letter stating that we have 87 seven days to submit all the supporting documents for I864 (for which I sent everything, including the last three pay stubs from my two jobs, one full time and the other one part time, the taxes and schedules and my bank account information). Then, the other reason why they cannot accept this request is because I do not meet the 125%. That left me with a big question mark because according the poverty guideline, for 3 people in my household, I am actually over 10K difference from the limit shown in that guideline? They mentions that I should get a joint sponsor....

If having a joint sponsor, that will be something difficult. I can't ask to my husbands family to help, his parents are divorced, we no longer have contact with his father and his mother is doing her best to survive.

My father is 70 years old and is the only one closer relative I have. I am married and currently my husband is under temporary disability. He is not a joint sponsor and doesn't really need to support my dad.

After I called today USCIS, the officer said that that could have been a mistake, maybe somebody overlooked the papers and did not paid close attention.

She advised me to speak directly to an officer and shown them the documentation I sent (I have copies) and see what they really require from me and why they state that I do not meet the limit... I have already the appointment for May 27th in the afternoon. Depending on how it goes, I may have to hire a lawyer, but first I want to make sure the reason of their arguments...

I am wondering if someone has had a similar issue? Any thoughts?

hi

so why didn't you send in everything without the joint sponsor?

if you didn't have one, you should have waited. it doesn't have to be a family member. it can be a friend or someone you know, as long as they are a USC or LPR and meet the requirements

plus they might have lost yours, if they are requesting it. so send in everything again

Aleful, it sounds like OP didn't have a joint sponsor and is above 125% of FPL based on their own calculation.

Ryan_and_Priscy: One thought, is that income consistent? As in were you above 125% FPL based on the full 2013 reported income or just the last several paychecks? or if you provided multiple years are they all at or above that range? It could have also been a previous W2 that maybe looked like the whole year's income?

Just some thoughts.

Previously I was working part time for a company and had my own business as freelance translator. The company I worked for as translator hired me last year beginning of April for a full time position while I kept my first part time job, plus I taught Spanish for private students. Basically I just added my full time job to the list from where I get my income. The income from last year is slightly higher, but even though my overall income for the previous years haven't been low. If that is a reason to consider "inconsistent" well, I won't have any other resource to have a joint sponsor, but the more I dig and ask to other friends, who have been able to bring their spouse and even a parent, their yearly salary was lower than mine and they did not even had assets, leaves me wondering....
