There are certain situations that new posters present here on visa journey that are complicated and even the bravest or most experienced members may choose not comment on. Your situation may in fact be one of those. You should seek competent legal advice.

OK, I will bite:

Well you can only stay here legally IF you adjust througha valid marriage to your wife.

And as that seems shall we say unlikely, I would be making plans to return.

If you want to subsequently Immigrate to the US, then you need to consider what other options are available to you.

Seems like if this was a woman asking for help everyone would jump on it, but since it's a guy, well maybe not?

Not necessarily true Gary. There have been posts by MEN in this situation who received a lot of help. Where is YOUR advice to the OP?

To the OP: I am assuming AOS has not been filed. IF your wife doesn't file AOS and the I-864 (affidavit of support) then you will be out of status and need to return to your home. IF you want to adjust status on your own, the best advice I can give you is to hire an attorney. I know you haven't any money (according to what I've read in your posts) but there are charitable organizations that can help with this, I would think if you have access to a phone and a phone book you might find such. I wish I had more information for you...and I am truly sorry for the position your wife has left you in.

I'm usually not too too eager to offer sugestions in these situations.....but if you are actually considering this, you should call any recruitment office of any branch of the armed forces and explain this desire. I think theres a good chance they would help you AOS without her if you enlist...I've heard of expedited citizenship this way too.

Of course there's a catch....but check it out. It might be what you want.

a K-1 visa holder cant join the military

The military will expedite citizenship for permanent residents, but in no way would it help a K-1 visa holder Adjust status.

My guts telling me he isn't here for the military, so this doesnt matter anyway... but there is too often noise on the tv debating allowing illegals to enlist, helping them get legal so they can join...he's not even here illegally so an aggressive recruiter just may get him assisance in aos-ing...and if she has filed anything, an aggressive recruiter might find him help keeping her submitted aos stuff alive and dont forget, they can help him get civilian work if they want to, possibly getting his ead lined up or maybe he recieved ead on arrival or maybe even help him get a more appropriate visa (so what if he had to go home to get it)...so you know what? If this is his ambition, I think he should fly it by a recruiter and see what happens. If he is down with working in iraq, I tend to think the military can make it happen if he really really doesn't want to go home or back to his wife- thats all I'm saying.

You have to be a Permanent Resident to join the Military.

Or a USC.
