curious about AOS (affidavit Of Support) when we live in canada..When we move we will have no incone

I just don't understand this whole thing. My husband is a USC and petitioner. He currently is a PR of Canada. He works here in Toronto, but once we relocate we'll have new jobs in the US (once we find some anyway) is this what NVC wants? Are they taking into consideration that this income is only what we have here and NOT in the US? Don't they want proof the APPLICANTS can be supported financially there and NOT abroad?? Please help!!

We do have a co sponsor, but does this mean they will disregard my husbands income completely or combine his current abroad income with the sponsors?

Have u seen the proving domicile topic at the very top of this forum??

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Yes, i have and have started gathering documents.

Such as :

SSN for USC

CRBA's for two of my children

Recently renewed drivers license

Bank account in the US still being used (statements)

Letter from mother-inlaw (that we'll be staying with her)

Letter from my husband stating he is ready to move back as soon as visa's are granted

Voters registration (currently trying to find the record of him voting in the last election through absentee ballot)

Moving quotes

Documents showing permanent address in the US

Correspondence from schools to find out registration requirements for my kids

Beneficiary - Applying for CR1/IR1 (but also played the K3 card prior to understanding it may be phased out.)

2013: July 20: I-130 sent (Chicago lockbox)

July 24: I-130 NOA1

July 24: I-129F sent (Dallas Lockbox)

Aug 2: I-129F NOA1

Aug 12: Alien Registration Number was changed, I-129F.

2014: Jan 28/29/30: - 3 transfer notices for I-130 and I-129F.

Feb 3 - Hard copy arrived -Notice of transfer to Texas stating Jan 29th.

Feb 10 - NOA2

Feb 27 - email stating I-130 being sent to NVC from TSC.

March 6 -NVC received our case.

April 7 - CASE NUMBER yay! IIN and BIN obtained and email given.

April 9 - DS261 available and filled in online.

Thank you so much for answering my question!! This is what i thought, but then I called the national customer service center and they told me its based on what his income is here even though we all will be leaving and my husband would not be employed.

No he hasn't but he has in canada. Is this a problem??

Well it a problem in that Americans still must do US taxes, no matter where they live.

I'm not sure what the next step is, others will answer I'm sure, but I believe in order to file an I864 for you, he'll need to file his 2013 taxes at least.... or be able to state why he was not required to... but if he's making income, I'm pretty sure he needs to be filing US taxes.
