Me and my husband are recently married, and about to file aos, but he wants to see about bringing his 21 year old brother. I told him i would find out more information. Since it is not my brother, and he is filing to adjust status, is there anyway that he can petition for him? I think i seen somewhere that my hubby has to be a u.s. Citizen and wait 26 years to petition for him?

 

8/22/15 Received notice of interview "call in letter" for September 1st 8am

9/01/15 AOS Interview Houston-APPROVED!

9/01/15 Card in production, Welcome notice has been mailed

9/05/15 Welcome Notice Received

9/08/15 Greencard was mailed

9/10/15 GREENCARD RECEIVED!!!!!!!!

6/2/17 mailed I-751 to csc priority mail

7/1/17 I-751 returned rejected (multiple items)

7/3/17 I-751 mailed again with signature confirmation

7/6/17 second I-751 delivered and signed for by Daniel Manchaca

7/22/17  Biometrics letter for 8/2/17

You husband can petition for HIS brother, after he becomes a citizen... What country is he from (as it has an impact on how many years it might take)...

4/4/2013. : Oath! Now a U.S. citizen!

You hubby can file for his brother once he is a citizen . No over stays would be forgiven as a sibling isn't an immediate relative. The wait is from about 13 years after filing for most places to about 24 years for the Philippines

This will not be over quickly. You will not enjoy this.

There is nothing you can do for his brother since no one can file for an in-law.

Only a USC can file for a sibling.

Your husband can apply for US citizenship after 3 years of having a green card based on marriage and living with a USC spouse.

When your husband becomes a USC, he can file for his brother. It will take 12-24 years depending on his brother's birth country.

So, the earliest his brother can immigrate here is 15 years.
