Me and my fiance are discussing which visa process to go (k-1 or k-3)

She already has a b-1/b-2 tourists visa that now has a time bar of 5 years. She was punished by one of the immigration border guards as she was going in to Mexico for having lied about where she was coming from. She did not find out about the Time Bar Punishment that had been placed on her tourist visa until she tried crossing again to the US.

She is not allowed past the border cities in the US (Eagle Pass, Laredo etc) but she can still go to the city.

I want to know what regulation or law covers this "punishment"

or for that matter what the offense was.

i'd also appreciate it very much if someone could tell me if this is going to be a problem for the K-(1 or 3) Visa that we are going to start.

I hope i was clear enough in the question.

The offence sounds like she lied. As you said.

Now, without any other information, that's the best we got. Would you like to give us more info? Had she overstayed? Why did she lie? What did she lie about? Was she working?

Don't bother with the K3, follow the path for the Cr1.

yes, the bar will affect the obtaining of the immigrant visa, she cannot come into the US without a valid visa, you may need a waiver. When is her bar up?
