Why does passport need to be valid for 5 years?

Item 11 in the guide says:

11. Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship.

Why would it need to be valid for 5 years? Mine expires in 2009 and I really don't want to bother with (or pay for) getting a new one (besides mine is full of stamps and visas and I want to keep them :-)

I realize that I can just give them a copy of my birth certificate by I'm really curious about this 5 year thing

Thoughts?

God I really should have done some of this with her last week when I was there!!!! Now I have to get her the bio thing and the letter of intent and all that and have her DHL it to me... ARGGGGG.

Our Visa Journey

07/29/07 ---- Mailed I-129F

08/25/07 --- Check finally cashed (8/27 I should be able to see the R number on the back).

08/27/07 --- NOA1 Arrives from CSC and I create my account profile on the USCIS.Gov web-site (the clock starts)!!!

02/05/08 --- After 191 days NOA2 (Approval) comes at last!!!!

2/14/08 --- NVC sends letter saying that it's on the way to the US Embassy in Bangkok

2/25/08 --- She receives Packet 3 from the Embassy

3/29/08 --- She receives Packet 4 with interview date (July 11th).

3/30/08 --- I e-mail the Embassy asking to make the date earlier because I've already got our tickets for June 13th!!!

5/6/08 --- No help from the Embassy. Rebooked tickets and vacation till September.

5/21/08 --- Embassy calls her and moves interview to May 27th!!!!! You have got to be kidding me!!!

9/21/08 --- POE San Francisco!!!!

12/8/08 --- Married!!!!

12/15/08 --- Mail AOS + AP + EAD package to Chicago

12/28/08 --- Come back from vacation and find AOS/AP/EAD NOA 1 and Bio App notices in the mailbox!!!

1/13/09 --- Bio Appt

4/22/09 --- AOS Interview "APPROVED"!!!

3/04/2011 --- OUR BABY IS BORN... We have a son!!!!!

3/10/2011 --- Mail I-751 application to lift conditions on residency

3/12/2011 --- I-751 Package received by CSC

3/14/2011 --- NOA 1

3/21/2011 --- NOA 2 (Biometrics Appt 4/18/2011)

5/27/2011 --- ROC Approved. 10 Year Green Card arrived 6/04/2011

Note: when you renew a passport, they just cancel and give you back your old one to keep, so you wont loose your visa stamps.

If you supply them a copy of your birth certificate then you wont need to use your passport to establish your citizenship, just need to send copy of visa stamp page to show that your visited your SO.

Note that the item you've quoted only says the passport has to have been issued with a validity of at least five years, that is, its expiration date must be at least five years after its issue date. It doesn't say the passport validity must extend five years beyond the current date. Note that the I-129F instructions say that the passport must be unexpired, and must have been issued with a validity of five years. There wouldn't be much point in insisting that it be unexpired if the phrase "issued with validity of at least five years" meant that the passport expiration date must be at least five years into the future.

Most passports issued to adult US citizens have a validity of ten years. Passports issued to minor US citizens typically have a validity of five years.

29 Apr, 2004: I-129F NOA 1

You are mis-reading the requirement. Most US passports are issued with a validity of 10 years. In some unusual situations the US government may issue a passport that is valid for only a brief period of perhaps a year or two. Such a passport cannot be used as evidence of citizenship.

When was your passport issued? If in 2004 or earlier (probably it was 1999) it meets the requirement.

Yup... was totally mis-reading that. I took it to mean that it needed to be valid for 5 years from the I-129F application date.

Sorry... my bad.

This site (because of all you fine people) is a fantastic resource and I'm so glad that I found you (thanks ThaiVisa.com). I do wish I'd been more prepared to file prior to going on this last vacation because I could have had managed to explain everything to Lek and get the signed letters and the bio form and stuff.

I hope to fully understand everything about getting a K1 and get my application in soon. I'll just need to get the stuff from her sent to me and then I should be ready to go.

I wanted to verify something about passports and visas.

My passport expires 2/09 and yet my Brazilian visa doesn't expire until 2010 (I think).

That means that I will need to apply for a new passport yet still travel with my old one - in addition - to show my visa when I enter the country?

(I'm going to try and get dual citizenship in the future).

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil
