I went to the interview today. Passed the test. But there was one year time my hubby and I didn't live together every day. We had jobs in different states with 3-hour distance. So he drove back to home and stay 3 days a week for that year until I finally moved to his state 2 years ago. So the officer said it wasn't full 3 years of living together. But he didn't deny my case but want more evidence. Anyone had similar situation? What did you do? reapply?

You haven't said specifically what additional evidence has been required?

At the end of the interview, the officer said he needs to talk to his supervisor and I will get a letter in the mail. He said the best scenario is I get a oath date. The worst scenario is I am denied. In between is "Request for evidence". I got an email right after i got home saying a notice was sent asking for evidence. So I have to wait and see what they want.

At the end of the interview, the officer said he needs to talk to his supervisor and I will get a letter in the mail. He said the best scenario is I get a oath date. The worst scenario is I am denied. In between is "Request for evidence". I got an email right after i got home saying a notice was sent asking for evidence. So I have to wait and see what they want.

While you wait, you could do the following in anticipation of a medium- or worst-case scenario response:

Medium Case Scenario (Request for Evidence): gather all evidence that points to a co-habitational marriage regardless of the time your spouse spent away from your primary residence due to work. The USCIS cannot ultimately penalise families who pursue employment opportunities if those families can show that they continued to satisfy their requirements to naturalise.

Evidence that could help you establish this could include:

1) Utility bills in both your names for the duration of the statutory period at ONE single address and the same address that is listed in your N-400 forms

2) A rental agreement/lease or any property ownership documents that show joint obligation/ownership of a single property, and the same property listed in your N-400 forms as your primary residence

3) Joint tax returns that show that you and your spouse associate the same residence listed in your N-400 forms as your primary residence

4) Any documentation that categorically shows that the temporary residence taken up your spouse was temporary, was for for work purposes only, and was maintained as a secondary residence simultaneously with the same primary residence said spouse shares with you

Worst Case Scenario (Denial): get a lawyer.

Of course, this could be more expensive than simply waiting to re-petition. However, if you re-petition, and this residence ambiguity remains in your statutory period, you may find yourself confronting this same issue in the near future. A lawyer would help you clearly assert any rights available to you before it comes to that.

Ultimately, it could simply be that the adjudicating Immigration Officer who interviewed you is junior and was uncertain of how your circumstances should be interpreted and prefers to consult a superior. I do not necessarily think you should fret...yet.

Of course, you could end up with a Best Case Scenario (getting the oath letter), and be able to put all this behind you quicker than you can say Panem.

But I now am facing very strange situation. I got two notices from USCIS today.

At 12:00 noon, I got this

"Your Case Status: Request for Evidence

On April 15, 2014, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail."

At 6:15 PM, I got this

"Your Case Status: Request for Evidence Response Review

On April 15, 2014, we received your response to our request for evidence. This case is being processed at our COLUMBUS, OH location. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283. We will notify you by mail when we make a decision or if we need something from you. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use the processing time information on our website to estimate when this case will be done. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283."

I didn't even get the letter and didn't submit any responses. Why it said they received the responses?

Is this odd? I start to panic now.

Do not panic.

Let us, for now, operate under the assumption that the evidence submission mentioned in the second letter refers to a "green light" at the USCIS to allow your case to proceed. It could refer to any verbal responses you gave to your Immigration Officer at the interview that are now being considered further. Because almost all correspondence from the USCIS to petitioners are of a standard format, they may not always fit the circumstances perfectly, and this apparent disconnect could be somewhat concerning.

However, your concern would not be misplaced, so here are two things I suggest you do:

1) Right now: make an InfoPass appointment at your local field office. If one is not immediately available, show up as a walk-in anyway (with your passport, Green Card, and all USCIS correspondence associated with your N-400 petition) and explain the circumstances. Get the office to definitively advise you as to what's going on.

2) Tomorrow morning: call the 1-800 USCIS number and persistently request to speak with a "Tier 2" officer. At that time, see if you can obtain specific information about the latest set of correspondence about your case. If the officer cannot help, then you fall back on your option in 1) above.

Huh, that is strange

Maybe the online status said what it said because they only have a limited amount of statuses. So they just chose one that best applied to your case? It could be that your interviewer had to check on something so that's when the first status appeared which was right after you got home. Then it was updated to what it is now because he is done checking whatever he needed to check...

If it stays the same I would call them tomorrow!
