I am filing an I 129F for my wife. We already have our receipt of application from the I 130. We are just slightly confused as the form is all based on a fiancé and the instruction form is all related to a fiancé too. So confused as to what info we actually have to include in the pack

Back ground info

Both live in UK now, I am a US citizen from birth, been married for almost 6 years, have 2 children who already have their US passports. We are wanting to move to the US permanently and ASAP

your already married, you don't need to file the 1-129f that's for fiancé not married yet,the 1-130 is all you need married 6 years cr-1-1r1,10 year green card, you may be looking at the k-3 with the 1-129f and the 1-130 together that's no longer needed any more.

We were advised by USCIS over the phone to file an I 129F after receiving the receipt of I 130 as they are usually quicker than the I 130. You can definitely file this form even if married if you read the paper work correctly. My children don't need an I 130 as they are already US citizens, they have their passports

the USCIS doesn't finish the process but no, it's not faster to get the I-130 and I-129F approved than just the I-130 alone. They adjudicated together according to USCIS policy.

The approved 129 is forwarded by the NVC to your embassy to process. More expensive, yes, but faster, well, we'll see how fast my case goes through. Medical next week, have no idea how long it will take for them to schedule an interview after they get results from clinic. ClockWatch2.gifClockWatch2.gif

And yes you can file a 129F even if you're married. It should really be called a fiance and spouse visa.
