IR-2 Category - Petition for Minor Children of a US Citizen

Hello All,

Anyone else with the same category as this? I've submitted the last supporting documents

required today (Visa Application supporting docs) so I'm just waiting for NVC to close my case

and transfer to US Embassy in Manila Philippines. Will it still take NVC 30 business days to

close my case even if they've already reviewed everything else (AOS forms and supporting docs),

all fees have been paid as well and all they have left to check are my child's

Birth Certificate (sent originals and copies), Copy of the passport's biographic page, 2 identical colored

photographs? Below is NVC Timeline for my case

Feb 24 - Ready for processing, NVC Case file assigned

Feb 24 - submitted DS-261

Feb 24 - paid AOS fee

Feb 25 - payment processed

Feb 28 - AOS fee shows PAID on NVC website

Mar 12 - DS261 acceptance

Mar 12 - Paid visa fee

Mar 13 - payment shows PAID in NVC system

Mar 16 - Submitted DS-260 (confirmation says wait 30 days for NVC to review)

Mar 17 - sent supporting docs for visa app

If you're talking about providing supporting documents for the DS-260, then I believe you do have to provide the original copy of the marriage cert as well as a copy of it. In my case I did not need to send a marriage cert to NVC as I already have my child's birth certificate as a proof of our relationship.

Now it makes me wonder, should I have my child bring pictures of us together to show relationship between us, or since he is my biological child, a birth certificate will suffice?

On NVC part, all requirements pertain to the beneficiary already. If you see a marriage certificate in the list, that is only if the beneficiary is married, since this is a minor(I'm sure he/she's not married), all you need to send with your DS 260 is anything that pertains to the minor. E.g Copy of passport bio, 2pcs picture, his/her birth certificate.

On NVC part, all requirements pertain to the beneficiary already. If you see a marriage certificate in the list, that is only if the beneficiary is married, since this is a minor(I'm sure he/she's not married), all you need to send with your DS 260 is anything that pertains to the minor. E.g Copy of passport bio, 2pcs picture, his/her birth certificate.

Actually I think the person asking is the stepparent of the beneficiary, correct? Since their name is not going to be on the birth certificate, I think it only makes sense they send the stepparent's marriage cert with the biological parent along with the rest of the supporting docs. I may be wrong but I think that makes sense. I hope other people can clear this up for you. Good luck!

You're right if the step parent's question is about filing I-130, it looks like he/she's asking if you need marriage certificate on NVC stage, my answer is no.

If they got approved by USCIS, it means that the step parent/ step child relationship has been established. Which means they already have submitted marriage certificate showing that the USC(step parent) is married to the child's biological mother/father before he turned 18.

On NVC stage , civil documents needed are for the beneficiary with the exception of IR5 and sister or brother of a USC. I don't want to go into more detail on this as this will just further confuse the matter. :)

You're right if the step parent's question is about filing I-130, it looks like he/she's asking if you need marriage certificate on NVC stage, my answer is no.

Hi all, yes it got approved by uscis, hence they must have established the step parent/child rlship. I called NVC today morning and they said i don't have to sent the marriage certificate as the beneficiary (minor) is not married.

I wonder.... Per NVC's website, they usually take 2-4 weeks to review my case. Is that 2-4 weeks from when they received my completed DS-260 or 2-4weeks from when they received the supporting docs for DS-260?

The day they recieved your files it will takes to 6-8weeks to review if there none has need to comply theyll email you for the next process if something else need from you then it will extend 30 days or so for RFE.

Assuming if has none so your case will probably Done by early may then will forward to consulate in manila takes 2-4weeks hopefully very soon around end of may or early june interview Goodluck.

They received the supporting docs and all the docs they asked for on the checklist last Friday, March 21st and I was told it will take them 30 days to review, so 30 days from March 21st. Wow! I was hoping to get an interview by May, looks like that's not going to happen as it looks like the interview is going to be in June, you're right! Oh well...it is what it is. Baby steps but we'll get there eventually.

When I completed the AOS Form, I used I-864EZ, turns out I had to use I-864W. That is all they've requested.

As far as the supporting docs for DS-260, I've submitted original and copies of my child's birth certificate, biographic page of his passport (copy) and 2 photographs. I've checked the doc required listed on NVC's website multiple times and these are the only docs I think that would apply to a minor beneficiary so I hope they dont ask for anything anymore.
