Hello VJ-

I have applied for an IR2 to for my stepson, my husband has applied to become a US citizen which should complete in the next three months, will my stepson be eligible for citizenship upon arrival? If yes, Should I apply for this at the embassy in Kingston, JA or should I wait until the child is on US soil?

NVC TIMELINE

01-NOV-2010: NVC Received Case

20-Dec-2010: Case Completed

US Embassy in Kingston

07-Feb-2011: Interview @ 8:00am

11-Feb-2011: Received Visa

16-Feb-2011: POE Houston, Texas

Removal of Conditions

07-Dec-2012: Mailed application

25-May-2013: Received 10yr. Green Card

If under 18 and in possession of a Greencard, then yes, the son will become a USC when the parent does. You'll have to get the IR2 first though.

Question for you. Is it a good idea or advisable to send additional evidence to NVC or take it to the interview? I sent marriage certificate, three money gram transfers, 10 pictures of traditional wedding, proof of two trips and two months of text message records to USCIS and petition was approved. Now I have more pictures, money gram transfers, whatsapp messages, one more trip and phone records to send to NVC during IV stage. Me and my wife are from Nigeria. Your response will be appreciated. There is no reason to contact the US Embassy.

The child must meet the 4 requirements of the Child Citizenship Act (CCA) to derive US citizenship from his US citizen father.

1. Have a US citizen parent (his father - it can not be a stepparent); AND

2. Lives with that US citizen parent; AND

3. Is under age 18; AND

4. Has been admitted as an LPR

If husband becomes an US citizen before the son immigrates, the son is still needs an immigrant visa because he is not a US citizen. USC dad can file the I-864w.

After he enters on his immigration visa and gets the I-551 stamp, then he will automatically become a US citizen if he meets all 4 requirements of the CCA.
