Hello and Happy new year to all! :)

I have some very newbie questions and I hope someone can help me. I just received an I-797, Notice of Action from my I-130 form. I was wondering if "I-797, Notice of Action" is the same as NOA1?

Also, is there anything I can do on my part while the NVC (Department of State National Visa Center) contact my beneficiary (wife)? Or I should just wait and allow at least 90 days before hearing from my wife if NVC correspond with her?

Any help would be much appreciated, thank you very much.

NOA1 was the first one you received - this is your NOA2 :) Congrats on the approval!!

You can have your wife start gathering the documents she needs if she hasn't done that already, and you can start preparing your Affidavit of Support so you're ready when they need it. Check out the "Guides" link on this site, it's very helpful :)

Hello Riblet and thank you for your quick respond. Thank you for answering my questions. Although, I don't think this is NOA2. If you check out my signature or timeline here, this is a very short amount of time. I thinking this I-797 Notice of Action is the starting of NOA1. I haven't even assemble the I-129F package yet, how would I receive NOA2? Hmmmm...

The good thing about this letter is that it said if I have any questions about visa issuance, I can contact the NVC directly but they suggest I give them at least 90 days before calling them if my wife has not received correspondence from the NVC.

Inclosing, I try to search the form I-797 on this website but I have no luck. I though I can learn what this form is all about and what action I should take next so, I miss her very much right now. By the way, that's a great photo of you two. :) Simply beautiful~!

Does the "Notice Type" say "Receipt Notice" on it? If so, it's the NOA1. But it seems an awful long time from cheque cashing to receiving the first receipt notice.

If it is just the receipt notice for your I-130 and you are filing the I-129F for a K3, you need to make a copy of that to include in the I-129F.

If it is indeed an approval notice, it seems that you never got your first notice (receipt notice) and you have your I-130 approved which is for a CR/IR immigrant visa.

In your signature you have the words "Approval Notice" next to today's date... does the I797C you received say Approval Notice of I130 or something of the sort? 2 months to approval really isn't that unusual, just good luck :)

The notice that was mailed out to you on October 25 seems to fit the timeline to be a NOA1 which is also on a I797C, and it should say something like Receipt Notice.

Do you know that you don't have to file for K3? And if you were going to you should have done so with your initial receipt notice. It sounds to me like you have an approval notice for your I130.

I-797, Notice of Action

Case Type: I130 Immigrant petition for relative, fiancee, or orphan

Notice Type: Approval Notice

Section: Husband or wife of U.S. Citizen, 201 (B) INA

The above petition has been approved. We have sent the original visa petition to the Department of State National Visa Center NNVC), NH 03801-2909. NVC processes all approved immigrant visa petitions that need consular action. It also dermines which consular post is the appropriate consulate to complete visa processing. NVC will then forward the approved petition to that consulate. The NVC will contact the person for whom you are petitioning (beneficiary) concerning further immigrant visa processing steps. If you have any questions about visa issuance, please contact the NVC directly. However, hplease allow at least 90 days befor ecalling the NVC if your beneficiary has not reeived correspondence from the NVC.

The approval of this visa petition does not in itself grant any immigration status and does not guarantee that the alien beneficiary will subsequently be found to be eligible for a visa, for admission to the United States, or for an extension, change, or adjustment of status.

Nope, that is a NOA2 (approval) for your I-130 application. Since you didn't send it for a K3 (which is the I-129F where the NOA1 receipt notice of your I-130 is submitted along with the I-129F) you're on your way to a IR/CR visa.

You'll want to look at the I-130 guide:

You can still file the I-129F for a K3 but you may want to just pursue the IR/CR visa now since your I-130 was already approved.

No problem. I've been obsessed over all this since I started this process so I did a lot of reading the last month or so (and continue to). It was really confusing to me at first but I learn a lot more everyday from everyone here. Good luck on the visa. :)
