New member/Same sex K1 advice :)

Hi!

I'm new to this forum, and also new to the visa process. I am a US citizen about to start the process of obtaining a K1 Visa for my fiancé living in France. We are a same sex couple and have no idea what to expect. I am so afraid that she will be denied and we will never be able to be together. I am a full time student, that lives with my mom, and I am afraid that is going to give them reason to deny us. I would really appreciate any advice y'all could give me!!!! This forum is great, I have only been on it looking for a couple of days, but I have found some excellent information!!

We have been together in person probably a total of 6months in the year we have been together. I was just there at Christmas and I am going back in May. Yes we take loads of pictures when we are together!

We communicate everyday through text messaging and video chat at the end of everyday

Okay great u can't apply. For K1 and fill out the i-129f and I will just advice you should send the paper works to Uscis office California cos that is the fastest uscis office since u have lot of evidence u won't be denied okay

The I-129F is mailed to the Texas lockbox. It is not sent to California. The address on where to file is included in the I-129F instructions.

For your case, you will not be treated any differently than a normal sex couple. You will need to prove 3 things with your petition:

  • You are a US citizen
  • You have met each other IN PERSON in the last 2 years
  • You are both legally free, able and willing to marry within 90 days of your fiancé's arrival to the US. You may also need to indicate the state you plan to marry, and that it is a state that allows same sex marriage.

Yep to the above. You can't pick where your file goes and you can't send it directly to CA.

Thanks so much for the information, we know we should be fine as we have nothing to hide it's just so nerve racking!

What about that fact that I do not have a full time job? Anyone know if that makes a difference?

My mom has agreed to help us out until I finish school, which will be within the next year.

At this stage of the process its nothing to worry about. When your petition is approved, then you will need to start preparing your I-134 Affidavit of Support. You will need to have an income of at least 125% the poverty level for your household size. If you do not have enough income, then just use a co-sponsor.
