I have a re interview on September 3 . . Ugh I don't understand why I have to re interview if I pass the English and writing and civic test. I hope it's a simple interview with a decision this time . I'm on my 5 month already and the time frame to naturaliza in san jose is 4 to 5 months only . My 6 month will be on sep 3 the day of my re interview. Any advice

To happy chic:

Yeah I had a past crime many years ago . But I cleared that with the iO.on my first intetview I also gave my IO COD . You think it's best for me to get an immigration attorney? I don't have that kind of money to hire an attorney.

I was reading pen codes about my past crime it's not deportable but I do fall under cimt . Here's what it states .

Penal §550(a) Insurance fraud Yes AF if offense involves fraud where victim lost $10,000 or more; intent. or AF if forgery and 1-yr sentence imposed. Yes CMT because fraudulent No. See Note "Burglary, Theft, Fraud." If $10k loss, try to plead to grand theft with a sentence less than a year. See PC 529(3) to possibly avoid CMT. If forgery involved, avoid 1-yr sentence to avoid charge of AF as forgery.

I do not owe over 2K I did not serve jail time . My pen code was 550 (b) 3 .

I'm hoping for the best on my next interview.

Do you think I will re take the civic test and English and writing test ?

What can an immigration attorney do for me on my re interview ?

I saw a forum here on vj when someone applied for naturalization N400 with 10 crimes and he was granted citizenship without an attorney. I also called a few non profit organization immigration law offices this morning about my past crime that is now expunge and dismissed . Ugh this is a very stressful process for me . Thanks for the advice happy chic . I m preying thay I will be granted citizenship

I think the problem is that you did not disclose the crime on your form and only brought it up on your interview. The officer was probably blindsided by it since they often read through the form before the interview. This is why you need a lawyer. As well as because you applied only 3 weeks before your 10 use gc expired. A lawyer can help you defend your case and would know the legalities of the immigration process. Goodluck pinoyme

Don't prey...just pray... ;) With your case, I would try to at least consult a lawyer and try researching about applying N400 w/ past criminal records. Good luck to all of us applicants!!!

Hi everyone! I wanted to share my interview today that went really well. Got there 20 minutes earlier but they called me 20 minutes late for the time scheduled for my interview. Parking was terrible and my husband have to find quarters because we didn't expect the parking was on the side of the road. Applicants are waiting for people to pull out the road before they can park. So I have to bring my little girl during my interview while my husband was away. Good thing she was sleeping :) The Immigration Officer was kinda serious and asked my passports (old and new), driver's license and greencard. On top of her table were all my bulk files and the N400 form which she went through all the details and questions one by one while checking it on her red pen. Good thing I reviewed my copy of the N400 form the night before my interview :) When she was all done she handed me the two forms to sign for it. For the civic test, she asked me only 6 questions since I answered all of them correctly. Next, she asked me to write and then read "Washington is on the dollar bill" Then she put back my all files in the bulk folder and gave me the Letter for the result of my interview and said "Congratulations you passed! You will need to go back here again though at the 1st Floor for the Oath Ceremony". She said they will mail me a notice for the schedule of the Oath Taking. Funny that as soon as I was done my little girl was up and the officer walked me out the door. The interview lasted for 20 minutes. I was so happy and told the officer that it was worth the waiting and the trip and she said "you're very welcome!

Congrats!
