firstly, i want to apologise for posting on this thread as i know i was suppose to be replying to the original message. I am new to Visa journey and been trying to post a thread in regards to my situation but i couldn't work that out.

my situation follows - I met my boyfriend in 2008 , we dated for a year then slipt up after, due to the distance cos he lives in london and i obviously live in america. then we both got in contact again in 2011 and we been dating since then and very serious this time , i have been to london back and forth since then. we planning on getting married now and trying to get him down here in america to start life together as a proper couple. my parents had met his family and he has met my family on the phone too.

Now here is the reason why i am seeking you guys help here on VJ, apparently we will need to both go back to his home country which is nigeria as he can't apply for k1 visa in th UK due to his immigration status, he wasn't living legally in the uk during the times i have visited him.. now he has moved back to nigeria and i will be going to visit him soon so we can both prove we have met each other before.

i am planning to file for him soon as i return from nigeria, my fear is won't that raise suspicion considering the fact that we planning to get married months after we met each other? Or should we declare we met in london couple of times while he was living there illegally? even tho he left the country now without any criminal records whatsoever. he left at his own will.

please any help on this matter would be highly appreciated by me!.. many thanks in advance.

You can use proof of your trips to the UK along with proof that he was there as proof of meeting , they don't care about his immigration issues there other than they will only do an interview in a country he is legally in . So you can show knowing him and seeing him all along and have a stronger case. The only illegal living they would hold against him would be here in the US

This will not be over quickly. You will not enjoy this.

Ahh.. Come to think of it.. Will OP need to provide police certificate from UK? If so, how will he provide if he is illegal?

Will he need to provide police certificate even tho he has left the uk?

I understand telling the truth seems the only way out here, however does anyone know if it is likely to be approved? and not going to end up been long, waiting times wise.

Sorry to bother you guys, hope you find time to reply to me... i am just desperate for answers please.

so i have been checking online to see how he can possibly get a police certificate in the uk, its almost impossible, in view of this i don't think the application is going to be successful if we want to stick to the story of us meeting in the uk.

How about i go to nigeria and to see him then file for k1 when i return to america . whats are the chances considering the short space in us deciding to get married?

second option is getting married in Nigeria, does anyone know how long the filing processing takes??

Please guys i need your help desperately, anyone with anyone information please help.

If he entered legally and overstayed they know he was there . He requests a certificate like any other persons ( if he used another name I hope you documeted in under the also known as section because not doing that can lead to a lifetime ban ) Hopefully because he was hiding his presence he didn't have anything to report

obtaining a police certificate won't be possible now as he is not residing in the Uk anymore. do you reckon the application won't be processed without it then? perhaps there is a waiver or something.

Thanks for your kind reply

People get police certificates everyday from UK and no longer live there. No there's no waiver and without the Police certificate you will not be approved.

No one can tell you if you will be approved or not. It's good he is going to Nigeria. You meeting his family face to face is a must.

Do you have red flags

1. Is there a big age difference (10 years or more)

2. Divorce

3. Children from prior relationships

4. Different religions

5. Not meeting immigrants family

These are just a few red flags that are issues through Lagos.

The Police certificate he can obtain anytime before interview since he doesn't live there its good for a year. he needs to get on that.
