(I'm posting this on behalf of a friend of my fiancee. Thank God we didn't have this problem ourselves!)

I have a friend who is a Filipina working in Kuwait. Her fiance is an American contractor who is also living in Kuwait. Their plan was to process through Kuwait, but they were just informed today that their paperwork had been forwarded from NVC to Manila due to either a misunderstanding or a mistake on her paperwork (they had a lawyer prepare the forms).

I know there is a process to request a case transfer, but does anyone know what the timeline for that is? Their lawyer supposedly told them it would take 5 months to get the case back, but he's proven to be pretty unreliable so far. They're also considering having her just fly back home and process through Manila now if that would be faster. Anyone with advice or experience care to weigh in?

07/19/2011 - Met while we were both working in Kuwait

03/18/2013 - I left Kuwait at the end of my contract and returned to the States

07/19/2013 - Got engaged!

09/24/2013 - Mailed in the I-129F packet to TSC

10/01/2013 - Received NOA-1

11/05/2013 - Received NOA-2

12/02/2013 - NVC receives the paperwork

12/03/2013 - Case number assigned

12/06/2013 - Case shipped to embassy

12/29/2013 - Case received by embassy

01/02/2014 - Interview scheduled for January 15th

01/07/2014 - Medical exam

01/11/2014 - Interview pushed back to January 22nd

01/22/2014 - Had the interview, was put into AP pending more documentation

01/26/2014 - Visa approved!

03/18/2014 - She entered USA

04/04/2014 - Married!

05/01/2014 - Filed AOS

05/09/2014 - AOS NOA

06/05/2014 - RFE for tax returns I didn't have when we filed

07/06/2014 - Biometrics appt in STL

08/13/2014 - The dreaded NPIW letter

04/25/2015 - E-mail notification of Green Card Approval!

There have been a few posters here who have had the same problem. It sticks in my mind that it took at least two months for their cases to be transferred to the correct Embassy.

If the beneficiary goes back to Manila, it could involve a significant amount of time. Her medical would normally have to be completed approximately one week before her interview. If St. Lukes found anything suspicious on her chest x-ray, she would have to undergo the eight-week TB culture. If her TB culture turned out negative, she then could proceed with her interview. If her TB culture turned out positive, she would have to undergo at least six months of treatment at St. Lukes.

After her interview, she potentially would have to wait a week or more to receive her visa packet...including her passport. Then she would need a day to complete the CFO seminar and to get the CFO sticker affixed to her passport.

I second that, last two I read about got their case files moved in a couple months, but I would never "take that to the bank".

It could be quicker to fly back to Manila and get things done. If you decide to go that route get the police certificate from Kuwait before you leave.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I too am one of those that had their case sent to the wrong embassy. I wrote about it here: http://www.visajourney.com/forums/topic/471357-nvc-sent-approved-k-1-petition-to-the-wrong-embassy/. I was frustrated, to say the least. I contacted the NVC directly. The representative transferred me to a supervisor, who put in the request. They explained that if it was my error they would charge a fee, to which I retorted, this was an administrative mistake on the part of NVC. I received another letter from the NVC detailing the transfer of documents. I ultimately had to contact my congressperson because I was told it could take up to 3 months to transfer documents. I thought that much time was ridiculous.

I called the embassy that had received the documents to make sure they had them, and confirmed the transfer order. Then, after several days, I called again to make sure that the wrong embassy had sent them to the correct embassy. I called about every three days to ascertain if the documents had actually arrived at the correct embassy. The DOS helped me by telling me when the documents had arrived. The embassy was not aware of the documents arriving until I told them that the documents were in their possession. It took about 1.5 months, but I had to stay on top of things.

Thanks everyone who responded, I've passed the info on to our friend who has the issue. For better or worse, she has decided to go back to the Philippines and process there instead of trying to get the case transfered back to Kuwait.
