Dear All, Please help.

I am USC , living in Pakistan. I am married with 1.5 years kid.

I wanna file I.130 for my spouse and kid. But I am 6 weeks pregrnant too.

1- Should I file for Spouse and 01 kid in Feb or March 2013 and after the delivery of 2nd kid (sep or early oct 2014) I will file for him/her?? will there be any issue?? If not, then what precautions should i have to take while filing for 2nd kid.

2- also please reply, how can i file the tax return on zero income, as i have not been to US since I was 15?

3- what can i do to establish domocile??

4- Along with the Co sponsor, can i show the income of my spouse (Doing Business here in Pk), which will continue after immigrantion visa also, will this help in showing financials with I 864 of Co sponsor??

kind cooperation and reply against each question will be appreciated.

but this time my question adds some more queries, actually, I m researching for this procedure of I.130 and I find it very confusing. Also it is very challenging for me to take up all this along with a baby. I hope u understand.

So , plz if u are following post that I was posted last month and now, then kindly help me out by answering my queries. Sorry to everyone if it feels like I am not getting the things smartly.

You will need a joint sponsor, not a co sponsor, there is a difference. You cannot file for an unborn child. You cannot use your spouses income as he isn't a us citizen or LPR

But can I show my spouse's income just as an add on, to strengthen my case.

Just a couple of questions:

Were you born in the US? or are you a naturalized citizen? If you were born in the US then you can file for a US http://travel.state.gov/content/passports/english/abroad/events-and-records/birth.html and you wouldn't need to file an I-130.

i got citizenship through naturalization.

Doesn't matter how you got citizenship -- even if you had been born in the US you would not be able to transmit US citizenship to your child(ren). You need to have been physically present in the US a total of five year, at least two of which had to be after the age of 14. Since you haven't been in the US since you were 15, you obviously can't have spent two years there after you turned 14.

You will need to do as you originally asked and, after the birth of the baby, file a separate I-130 for the child.
