You could do NOTHING related to your future job. If you are an engineer you had best be washing dishes. It would have to be a position that is normall unpaid at the company and NOT related to your future job.

Even a position at a company that maybe the company wouldn't pay for, could still be considered a paid position (either by money or other compensation) by the Department of Labor.

The Department of Labor defines a volunteer as "Individuals who volunteer or donate their services, usually on a part-time basis, for public service, religious or humanitarian objectives, not as employees and without contemplation of pay" and also "Under the FLSA, employees may not volunteer services to for-profit private sector employers."

Basically, think of volunteering as doing charity work and nothing more.

alright, thanks for the info.

so how about this: my future employer creates a volunteer position that is strictly not paid. in the future i would hold another position with that company. that would work, correct?

different scenario: i'm also in school back in germany and still need my internship. i could fill an unpaid internship position correct?

Nonsense, you just got here, got married and want to "fool or cheat" the system already? Are you serious? Just wait... both you and your employer can get into serious trouble. Just wait!

You could actually volunteer at a nursing home where they have volunteer positions and volunteer policies already in place. My wife did this and was later hired at the same nursing home, however our case is different than yours because she had her green card within 30 days of landing in the US as we had been married in the Philippines prior to her moving here. This was somewthing we planned because she knew she didn't want to sit around the house for 3 or more months going stir-crazy. Some people plan, some don't. Within weeks of arriving here she signed up for and completed a CNA course. Volunteering at the nursing home simultaneously. We used VJ throughout the whole process to assist us in making decisions and without it I am sure we would be still processing papers. Thanks to VJ and all the helpful members here!

IMHO...My bet here? Someone's gonna get a "volunteer" job anyway.

hey folks,

so i'm in the states on a k1. our wedding is scheduled for 2/15, which means we could file for the AOS around 3/1 (we will have to wait for a copy of the marriage certificate). i had a job interview today and they really really really want me to start ASAP. i offered to volunteer until my work permit kicks in, but i'd rather get paid smile.png

is there any point in filing for the EAD card now. i know i would have to spent $340. or should i just wait for 6 weeks?

Hey Christian! You wasted your time, alas. Sure, it's great experience to go for a job interview, but...

I know, it's difficult, when yer getting antsy just sitting around the house,

however. ...

Go Get the Job, after the EAD is in yer hands, after the AOS set is filed, after you two marry. Whilst yer waiting, this week, go get the SSN at a SSA office.

OK? OK !

You might get some speed asking for expedite of EAD. Use the advanced search tool, 'EAD Expedite' on the search terms. [Don't see it? come back on a PC, try again]

thanks, i didn't want it to go that fast. my old employer forwarded my resume and the place ended up calling me asking me for an interview. guess they are short staffed and looking for someone with my skills. but i was up front with them and told them about the situation i'm in.

i got all the paperwork i need, ssn, driver's license, complete aos package. we're just waiting for the wedding, the certified copy and off it goes.

in the meantime, we do have a wedding to plan. which will be nothing short of fantabulous. so i'm looking forward to that.

10 March 2014 - Case arrived at the Consulate...
