My fiancé, now my wife came October 1, 2012. I estimated the time to get married was to have been in January. We got married on December 20th. I am getting to do the AOS but when I read the entry sticker in her passport, it said it expired on the 17th of December. Everything said we must marry within 90 days. Did I do some drastically wrong?

Should be ok since you marry at the 81 days mark.. You can still file for AOS. What does her I-94 date says?

2012 ? what ?

I think you were ok on the marriage date, as that was less than 90 days past the POE date.

I'm very confused, could you please finish up yer official timeline?

if you are only now filing AOS,

if there have been 2 years past expiration of the I-94, then you must file the I-130 plus a new medical exam with the I-485 set.

as to 'entry sticker' - there is no such thing containing an expiration date.

there's a big visa stamp on one page - but if she entered the USA prior to the expiration date of the visa, she's OK as a K-1 visa holder.

Somewhere there is an I-94 paper, stapled to the passport (if, indeed, she came in, in 2012) and there's an expiration date stamped there.

To be eligible to file for AOS, you only had to marry within 90 days of entry. Typically the entry stamp/I-94 is marked with a 90 day expiration time that coincides with the amount of time you have to marry, but not always. The I-94/entry stamp date controls your status in the US. It does not control the eligibility for AOS.

She came in 2012 and you are just now applying for AOS? You have not been married for 2 years yet, so no need for an I-130 with the I-485. It has been over a year since the K-1 medical, so a new medical is required.
