Changing of status

Hi Everyone,

I have been in US since July thru K1 Visa and I was able to get married same month but was unable to file for AOS since then due to unexpected financial issue and I probably wont be able to do so until late February 2014. My Question is if I have to be worried since I already exceeded 90days and 90more days before I cud file.

There is no deadline for a K-1 to file for AoS, but you begin to accrue overstay after your I-94 expires, and could be detained by ICE (theoretically) since you are out of status.

Your overstay will not be an impediment to your green card being approved, however.

As long as you married within 90 days of entry, you are eligible to file for AOS. There is no deadline to file. You will be out of status when your I-94 expires and cannot work or leave and re-enter the US until you get your EAD/AP or green card, so file as soon as you possibly can.

thanks gowon ..... Infact, as soon as super humanly possible paapa and that's why I wanted to hear peepz opinion about d situation.
