There is no magic number for making marrying on a visitors visa ok. As a Nigerian you will be look at more closely than others. That is the penalty for the fools that behave so badly have laid on the rest of us.

You can't petition anyone you have no status to do so. And you are requesting a change of status to become a Legal permanent residence and petitioning your kids same time. Very suspicious and risky to say the least.

But your US citizen/LPR spouse needs to be petitioning for your kids not you. Hope you did that right.

I can apply along with my kids if my wife accept nothing is wrong about that because both me and my kids will get visa the same time because if u want to apply for them later they will ask you why u did not apply it together with yours at the begging

What is key to applying for AOS is if they had any doubts when you entered and what they asked you for questions. The safest thing to do would be to go home and your wife apply for you and your children together. If you already have children do you have the papers of divorce from that marriage. It is high suspicious that would would happen to come to the US on a visit with copies of your divorce papers. Something like that can get you denied and then your process will take much longer

For you to have come to the US with all the papers necessary to file to adjust status shows that you had intent to abuse your visitors visa and stay. This could lead to a lifetime ban from the US. It is much safer if you return to Nigeria and your wife files the I130 ( and you interview from Lagos )

I got the papers here my brother send it to me I have ask people nothing wrong with that since I am married and I file 485 &765 130 they said nothing wrong so far the marriage is real and we leave together nothing wrong no need to go back to nugeria

The issue I see with your case is your timeline. You say you have a 3 and 1.5 month old. And now you are in US remarried. That is a fast time line. Can you answer these questions.

1. How long have you been divorced?

2. When did you meet your now wife?

You coming here to visit than marry and immediately petitioning for your children may seem very suspicious. Lawyers will always say its okay no wahala to file Adjustment of Status. but you are from the highest fraud country in the world dear. EXTRA SCRUTINY is on you.

If you have been divorced for a year you had sex after the divorce because the baby was conceived less than a year ago. Lawyers in the US are used to dealing with people that come from low fraud countries thata don't have newborns back home from some other woman They will get paid even if you are denied and yours is one of the most deniable cases I have seen posted . People don't meet and marry a stranger when they have a new born at home. You left before the baby was born and now you want to bring it here. I would guess there is a high chance that your AOS will be denied,. Nigerians are famous for thinking they can play games with rules ( like the LPR who decided that voting for Obama because he is African wouldn't affect his citizenship petition )
