Anyone can help me pls!!!

Hi to all member of VJ!! I write this letter for everyone who can give me advice ,i do really need you to give me idea what we can do for our problem. I got married with my American Husband last April 12,2013 and my husband he filled I130 which is spouse visa and we got approved last December 17 (NOA2) , i have 2 kids from my past and we have plan to take them after i go to America but the birth certificate of my kids it was written there that I was married to their father (Pilipino) which is not true. My question is What can be done to fix it before i go to America! There's anyone have done this before pls help me im so much appreciate it! Thank you in advance!

Warning: This is only my suggestion. I'm not sure with this! :o

Have you tried calling NSO or asking a lawyer? As far as I know, a lawyer will need to prepare the petition for correction of entry. I'm not 100% on this but I highly suggest consulting a lawyer at this point. I think you need a court order to correct their birth certificates.

I don't know what the issue is, does it bother you that it states you were married to the man? You have sole custody of your children so there is no issues with you bringing your children to the USA. You have the NSO marriage certificate and CEMAR showing you are married to your husband... all is good as far as I can see.

I'd leave well enough alone as Hank has said. No need to change anything because you are currently married to your American husband and by Filipino law you have custody of the children because you are there mother which allows you to remove them from the Philippines when you are ready. Just be sure their passport and BC match and use their names to meet all the documents you will be submitting.

Thanks Hank! That's what I thought too. We did talk with attorney, and he filled us with a load of ####### about needing to spend 300,00 just to make notation on birth certificate. I think we will go with it like you said she has full custody so shouldn't be a problem.

My advice is not connected to your "issue" but I would recommend that you apply your kids' passport while you're still here in the Philippines. smile.png

Apple 21 do you think it will be good if i will apply for them passport before i leave philippines? even theire BC is written there that i was married to theire biological father? Before i asked to the department of forein affair about this and they said ,,they can issue the passport for them but they cannot do anything about theire BC, just they will follow all what's the written to theire BC!! So i was worried it might be complicated when we start to apply for them a visa !!! thank you for your early advice, im so much appreciate it! :)

DFA will follow whatever is the kid's name on the BC. They don't have the authority to change or ammend the BC coz that's the job of NSO.

It will be easier if the mother accompanies the child during the application especially for illegitimate children. If you're already in the US and its time to process their civil docs, you will have to execute a special power of attorney for whoever will assist your kid in applying for a passport. To avoid that additional hassle, apply for them now. :)

That won't be an issue when you apply for their passport.

Me and my hubby still waiting for my case number from NVC to complete the processing our papers, i know once we recieve our case number from NVC this is the time we will become busy (and no time to get all the paper for my child needs). And this is my question "what more papers or document that i need to get for my child,except passport ? Do I need to get DSWD certificate to allowing them to live america with me,? ( because i want to accomplish all the papers for my child before we recieved the the case number from NVC. In order once i get there in America i want to bring with me all the documents because for my first day in america we will apply for them also I130 to follow me, (both they are minor), pls anyone can give me advice to this kind of problem, "help me" my pleasure to read all reply! Thank you in advance!!
