My husband and I married in October 2011. We are now filing ROC. While I have extensive evidence of our married life and financial comingling, most of the evidence doesn't begin until April or May of 2012. We do have an IRS transcript of our married filing jointly taxes from 2011. But, because my husband did not receive his Green Card and get a job until April of 2012, we waited until that point to open a bank account jointly, get a car and get joint car insurance, etc. He didn't really have much need to do so before since he didn't have a job. Do you think that will be an issue?

Also, I am the USC and I changed my name, but not right away after our wedding. So, some of our evidence (primarily, boarding passes since my passport is in my maiden name) is in my maiden name and some is in my married name. Since I am the USC, there is no place no note a maiden name on the 751 form (just for the LPR). So, how will they know I am the same person? Should I outline that in the cover letter? Will it be an issue I didn't change my name right away? I don't want any confusion.

Do you think that will be an issue?

Also, I am the USC and I changed my name, but not right away after our wedding. So, some of our evidence (primarily, boarding passes since my passport is in my maiden name) is in my maiden name and some is in my married name. Since I am the USC, there is no place no note a maiden name on the 751 form (just for the LPR). So, how will they know I am the same person? Should I outline that in the cover letter? Will it be an issue I didn't change my name right away? I don't want any confusion.

I personally don't think that not having evidence in the first few months of the immigrant spouse coming to US will be a negative, as it take some time to get all those setup and we personally do not have evidence for the first few months and am not expecting any RFEs.

Changing the name of a wife has never been an issue with the evidence having the maiden name. My mother's certificates have her maiden name and that wasn't an issue during her employment after moving to USA. Just indicate your name change in the covering letter, which should be fine.

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)

10/30/11 - POE - Houston, TX

10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

No issue, it takes time to get established and everything sorted out paperwork wise... I never changed my name.

How about his name on the lease or health insurance or joint credit card. Somewhere on your job application or papers you may have mentioned him as your husband...maybe as a beneficiary or point of contact. You should add those in the documentation.

Also you should highlight in your cover letter your 2 different names. It will help the person jusdging your application. Think of process as if you were getting this package and what sense it makes to you.

I changed my name later too, and it was not an issue to have used my previous name for the AOS paperwork and then my new married name on the ROC paperwork. You can always make a note on the cover letter to state that some of the evidence is in your maiden name and some is in your current married name. Even without the note, I think it will be fine.

Just send everything you can from the beginning of the marriage until now. If all you have is the joint tax filing for 2011, then that is all you have. Joint tax filings are solid evidence, so that works in your favor. Just like with the name change, you can make a note on the cover letter where you list the enclosed joint bank evidence to state that you did not get a joint account until he received his green card and began working. We had one joint account from when we first married, but it never had much in it and was not used. We closed it once he received his green card and I added him as joint on my already existing account. Had no issues at all with ROC.
