Bringing Brazilian fiancee to wait in Tijuana

Oi galera:

My fiancee (beneficiary) is from Brazil and I live in Los Angeles. Since Brazilians do not need a VISA to enter Mexico for 180 days, and Tijuana is only 2 hours from me - driving, we have decided that she will come and stay in Tijuana Mexico till the interview.

Does anyone know if any reporting issues would ensue? She's in Mexico as a tourist, so just visiting....I also assume the K-1 process is fairly quick right now and we'll have an interview in Rio, well befor her 180 days are up in Mexico.

While there, she is going to go to English classes and study for the Nurse Board Exam since she's a registered Nurse in Brazil.

As long as she can receive the instructions and info she needs from the consulate in Brazil, then I see no problems with her staying elsewhere while waiting for her K-1 interview.

Can we get all the info and instructions online? Mail in Brazil is unreliable anyway. Her family lives at the same address, but I would rather not rely on them to get pieces of mail for her.

As the petitioner, you will receive all the correspondence and have on-line access to information for everything until your file reaches the Rio de Janeiro consulate. At that point, you can email the Rio de Janeiro consulate and they can provide you with the interview date via email (the interview date is generally no more than two months from when Rio receives your file). The consulate may send a letter to your fiancee at her Brazil address as well, but as long as you have the interview date all of the other information and instructions that you will need are available on-line, so the physical letter is not actually necessary. Remember that your fiancee will need to have her medical examination in Brazil and get copies of her police records as well, so she will probably want some lead time back in Brazil prior to the interview.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes she is getting her state and federal police records before she even comes to Mexico, and all other paperwork she cab obtain now. All she will need is hre medical. Thanks guys!

hey i know this is a split topic now.....but i have a question for OP....did you end up doing the mexico thing (i am going to do the same with my husband)? did you have any problems? when you did the interview did you have any problems with documents? i see that rio requires that you bring original docs even if you already submitted to NVC....did you do this...did they look at them? congrats on your approval!!!! thanks

Yes, she came to Tijuana for 2 months. It was no problem in any way and probably helped establish the fact that there is a current and ongoing relationship. I did mention it to them, but they declined to even look at any evidence that this was true. They did ask my fiancee what color my car was and all that, since I had told them I had driven to Tijuana with my car from Los Angeles.

Rent an apartment in Playas de Tijuana - Playas Diamante complex - if you can, $350/month with ocean sunset views and security.
