Hello everyone!

I came to America on an F1 student visa. I met a guy who is also a USC naturalized both from same continent, Africa but different countries. We got married in June 2008 and I adjusted my status and got my 2 year GC in February 2009. In 2010 December while I was removing conditions I found out my husband was cheating on me with someone from his country who did not leave in the USA. She was his high school sweetheart. He made a trip to his country on a visit to his father, they got together and this other woman got pregnant for him. He hid this from me till April 2011 right after I removed conditions to tell me we should end this relationship but never told me he has gotten someone pregnant. During the time I was removing conditions, our phone bills was rising to 1000$ a month due to him keeping up with this woman everyday and whenever I talk about it he tries to fight me. I even got pregnant while I had lost my mum and didn't think I was in the right state for a pregnancy also together with his behavior and him telling me thers no money to raise a baby. ( I have scans from hospitals etc). He talked me into aborting and I did. After I realized and heard from people he's going to have a baby and I thought they were talking about my pregnancy with him. But to my surprise I was wrong, they were talking about this other lady.When I found out I was so devastated and decided to let him go. As soon as our divorce was finalized, he got married that same month to this lady and filed for her and his new born baby and I left the state to live my life obviously very ashamed.

Fast forward to 2012 I met a guy who I fell in love with but is not here in America. I want to petition for this guy but I just recently submitted my n400 and looking at others timelines, I have come to conclusion I will not be a citizen till April. As at now I went to my home country to get married just last month and found out that I am pregnant. With the current USC petitioning for family members taking forever and LPRs now current, I will want to know if I can file for my new spouse. Now I have read the130 Instructions which says I will have to be a permanent resident for 5 years before I can petition for a spouse if I got my residency, through an old spouse unless I can prove my marriage with the old one was bonafide. My question is should I just wait till April when I become a citizen and file for him? Or can I submit and file for him now and try to prove my relationship with my ex was bonafide? I have all our tax returns, bills, my pregnancy appointments and scan while we we still married and emails from us when this whole sage started. I wouldn't want to complicate things for myself but I live here all alone and I will really want my husband to be here at the time I am due to give birth which will be in August 2014. My plan was to file while am still a LPR and prove my ex marriage was bonafide and update my status when I become a USC. Please any advice on this will be appreciated. I am not here for anyone to judge me or say hurtful words. I have gone through enough already... Wait till you walk in my shoes before..

Ps: my ex husband obviously has felt very bad since he found out I heard he's brought his new family here. He has been trying to contact me to apologize and I couldn't forgive him till just last year when I realized I have to forgive him, myself before I can move on with my life. I have contacted him for a notarized letter stating our marriage was bonafide and he has agreed. I feel this will also help a lot.

Everything happens for a reason, huh?:)

I know that LPR'S are current now, but if the rules state that you have to be an LPR for five years and you are not then I would advice you to wait till you get your citizenship, it's only a few more months :)

I can not think of any marital immigrant route which would get him here by August next year.

I know that LPR'S are current now, but if the rules state that you have to be an LPR for five years and you are not then I would advice you to wait till you get your citizenship, it's only a few more months :)

Thanks for your concern. Everything certainly happens for a reason.. If human beings are to live by this we would not worry a single bit when anything goes wrong, we will know there's a way. I think I will take your advice and wait tilli get my citizenship. I just wish I could have him around while I give birth.

I can not think of any marital immigrant route which would get him here by August next year.

In other words even if I go out of my way to petition for him now while still a LPR, there is no way he would get here for the birth of our child. Is that what you're saying? I kinda agree with you you. Maybe I will wait after I get my citizenship and file for k3 as well who knows? I just hope and pray for the best..

I think you should talk to an immigration attorney to get this straightened out. They would be the best person to advice you on the laws and workings of USCIS with respect to your case. Simple consultation for 30 mins should help would be my take.
