Hello there,

First and for most, thank you for your help in advance.

And this is the problem:

My wife was granted an interview in her home country, however they asked her for a new/different affidavit of support. As a matter of fact, I'm still a student and couldn't/not able to file taxes until today. So, my cousin agreed to be my joint sponsor, but the problem is that his 2012 income on his IRS is slightly below poverty guidelines; however, his employer has provided him a letter stating that his CURRENT income is $75,000.00 which would be very good if I can use it instead of his 2012 income.

So, can I put on form I-864 that his CURRENT income is that what was provided in the letter from his employer and use it as an Affidavit of Support? Would it, then, be accepted? Or only incomes from his IRS are accepted?

Also, in case the answer to the above question is 'NO', I'm planning on filing taxes this year for I started working part time while coping with my studies. Therefore, if I file taxes above poverty guidelines, can I use that to sponsor my wife although I only filed this year?

Income tax is basically to show that you are filing taxes. If he have a letter and paystubs that should be suffient to help you. Still needs to show taxes regardless of the amount of money that was reported.

Include the paystubs and bring the most recent one to the interview.

we are done with the interview and sponsorship was the the only issue and they asked us to mail it to the embassy once it becomes available.

You should send pay stubs and the employer letter. Honestly that is a large jump in salary and I think you'll need more proof than just an employer letter.
