case approved pd not current

Hello everybody I'am an Newbie here ,I filed a petition for my wife on september 23rd 2013 my case was assigned to VSC my Pd is Sept. 30 .I received my NOA 2 this week. Now i have a few questions. I was very lucky to have my case approved in VSC so fastdancin5hr.gif

I heard the next step is NVC

1- Does Uscis will transfer my case to NVC even my PD is not current ?

2- (If 1 is yes) Does Nvc will start the process or it will wait until my PD is current?

07/26/2013 - Johnny went visiting
07/29/2013 - Got married in P-au-P
09/23/2013 - I-130 sent
09/30/2013 - PD
09/30/2013 - NOA-1 received in email

10/03/2013 - NOA 1 received in the mail
11/13/2013 - NOA-2 approved (in email)
11/18/2013 - NOA-2 received in snail mail

11/25/2013 - NVC received the case

12/05/2013 - NVC assigned case number

05/22/2015- NVC case completed over the phone

06/01/2015- cc email confirmation

Interview 08-05-2015 7AM Port-au-Prince

06/06/15 Ceac in AP status :cry: (they ask me for joint sponsor)

10/02/15 Ceac changed from AP to Issued (after almost 2 month)

10/07/15 Passport with Visa oh hand :dancing:

10/18/15 Ready to enter in US JFK airport

congratulations for the approval. but it is very unfair that people are getting approval with in couple of months and we are waiting from many months. total unfair and injustice.

Congrats on your I-130 approval. Here is the answer for your two questions on what happens next.

USCIS Sent My Immigrant Visa Petition to the NVC. Now What Happens?

If your Priority Date meets the most recent Qualifying Date, the NVC will:

  1. Invoice you for your visa application fees
  2. Collect your visa application and supporting documentation
  3. Hold your visa petition until an interview can be scheduled with a consular officer at a U.S. Embassy or U.S. Consulate General abroad.

If your Priority Date DOES NOT meet the most recent Qualifying Date, the NVC will notify you and hold your petition until your Priority Date meets the most recent Qualifying Date. The Department of State updates the Qualifying Dates on a monthly basis.

1) How long have you been waiting?

2) Did you contact USCIS? Did you talk to a tier 2 rep?

3) Where is your case located? Which Service Center?

4) Did you get an RFE at some point?

5) Did you do a I-130/I485 concurrent filing (AOS) or Consular Processing?

6) Did you get an Infopass to get more info about your case?

7) Did you contact your congressman/congresswoman/Senator to check on your case assuming your case has crossed the processing time indicated in the USCIS website.

Sorry for all the questions but if your I-130 is pending beyond the processing time you could take some action on your case and get some Info on it.

I will be surprised if it is sent for further processing before the PD is current.

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

I've been waiting for 44 days

I didnt contact the USCIS I did not talk to any one

3) Where is your case located? Which Service Center?

My case was send to Chicago Lockbox and after send to Vermont Service Center

4) Did you get an RFE at some point?

I did not get any RFE

It was Only 130 concurent filling for my wife and my 2 kids

6) Did you get an Infopass to get more info about your case?

I did not get infopass

7) Did you contact your congressman/congresswoman/Senator to check on your case assuming your case has crossed the processing time indicated in the USCIS website.

I did not contact any congressman

Sorry for all the questions but if your I-130 is pending beyond the processing time you could take some action on your case and get some Info on it.

It's ok to ask question, I send my petition on September 23rd ,2013 receive my No2 on October 4th with PD 30th September and get my approval on November 13th

Now I have wait my PD to be current, I dont know how long im gonna wait
