I submitted my application for AOS and received a REF for I-864 and I-94.

I submitted I-102 for a duplicate of I-94. My entry records are very old...late 90's.

My passport and I-94 were stolen in '98. So I have no copies of nothing....

The ONLY thing I have is my FOIA records which shows my I-94#, when I entered, flight info, who inspected me etc.....

It also shows that I never left. I had requested for an expedite for I-102, and received a letter y'day that it was denied. So I have to wait 2.5 months for it.

So, should I go ahead and submit the evidence needed for I-864 and my FOIA records in lieu of I-94 and see if they would accept is

as an alternative proper evidence of arrival? I am just concerned that if I wait for the duplicate I-94 it will arrive after my deadline to

submit the evidence required.

Please help!

09/16/2013 - Completed Biometricks (Walk In)

(Long gap in sending RFE back because I had to complete I-94 application and tried to wait for decision but ended up submitting RFE for I-864 with I-94 NOA)

11/29/2013 - RFE response sent

12/30/2014 - EAD received

01/06/2014 - I-94 Approved!!!!!
02/06/2014 - Interview (had to go back to civil surgeon to re-do paperwork and make sure this time he signs it. Took care of it that very same day and dropped it off at the USCIS office the following morning.
02/14/2014 - Green card received!!!

You should have sorted out the I-94 before you filed AOS. But, for now, I would send in the FOIA stuff, maybe it will buy you time.

you should write a letter of attestation

one for each 'thing' you are having problems with.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

You can try but they're notoriously picky about the evidence they will accept as proof of legal entry.
