My wife came to the US on a K1 visa, we got married and about ready to apply for AOS .... but we don't have a SSN number for her and she's not on my bank accounts or lease. Will this be a problem for the AOS? ... proof of being married and living with one another.

Also sucks because she cant go get her drivers license.

Reason why we don't have a SSN is below;

Late August we applied for a SSC in Michigan , they said it could take up to for weeks.

September we got married.

Called the social security people on a status and they said they need to send some more paper work and everything is good

Government shutdown .... I called the SS people again and they said because of the government shut down they wont be able to see anything ... call back after the shutdown.

after the government shutdown .... called again and they said they didn't see the file anywhere! we need to come back and file again.

Oct 17th Went back again and the lady said we need to do everything through the IRS for her to be on my bank accounts and so on .... I said ok but please lets try getting her a SSN not authorized to work ... due to her being on a K1 visa. The lady did everything again and said she needed to send USCIS her information and this can take up to 4 weeks.

October 30th ... today I received a letter saying;

" Due to the government shutdown, we are not able to continue processing the application. Please contact USCIS to update the status. Your admission date stamp is too near the expiration date. System is kicking out "

Her K1 expires November 14th

I've been waiting for her to have a SSN number so I can add her to my bank accounts , lease ... and so on before we apply for AOS.

Congrats on your marriage! Do not worry too much, you do not need to have a SSN to add her to your bank accounts or lease you can use herA number for that. This is what I did. Also you do not need to supply all these documents (proof of bona fide marriage) for the AOS, you're just suppossed to have them for the interview (if they decide to have one). As for SSN I'm not an expert, but I'd wait for the EAD to arrive and then would go to get the SSN.

However, we should wait to hear more opinions in case I'm missing something.

I know it is difficult to wait... I know you feel like you're putting your life 'on hold', but believe me at the end it's all worth it!

when does the I-94 expire ?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

no clue , they stop issuing paper I-94's

Right, but you can go to the CBP website and get a printout of the I-94 and see when it expires. The K-1 expired when she entered the US and is no longer valid or relivent. If the I-94 is within 2 weeks of expiring then she missed the window to get the SSC based on teh K-1 visa and now must wait for her EAD (employment authorization) or GC.

Without the SSN it will be harder to get bank accounts and all that, but it is not needed. Getting banks to agree will be fun. I would go back to teh SSA if your wife's I-94 still has more than 14 days before it expires and get her SSC in the VISA name. Do not try to get it in the married name as the employees at your local SSA office have no clue by their answers already given to you--so do not push your luck by trying to get the SSN in the married name at this point. Once you have the number you can add her to all things financial.

Good luck and goto http://www.cbp.gov/xp/cgov/travel/id_visa/i-94_instructions/ and enter your information to get a copy of the I-94, you need a copy of it for the AOS.

thank you!! and the I-94 expires November 12th .... so maybe we'll get lucky;

The letter is for the first time we applied for a SSN and because of the gov shut down they kick us out

and they will accept the second application for the SSN on the 17th of October..... if not we'll have to wait for EAD.

ok - go back to SSA office tomorrow, apply for SSN, in VISA NAME, show I-94 and passport.

you have small chance they will accept it, but still, take that small chance. Why is it small? It's right outside the window (usually on day 74 or greater of POE date they will not process it)

and maybe you will have sympathetic supervisor on Friday morning. IMO, you need one of those. You might get one, seeing how they screwed it up there, earlier for SS-5 intake.

fwiw - visa is invalidated on POE entry, this 'expiration date' in the visa was the latest date she could legally enter the USA (even then getting a new 90 day with the I-94)
