student visa question - need help asap...

I have few questions. I am from India and I am a doctor(mbbs) here. I like to come to USA and like to get my USMLE done their and get my H1 visa. My plan is to get in to some college with some type of degree in medical line on student visa that I will follow and take USMLE on side with it. Some of my friends are doing this currently in USA. Do you know if this is legal? Would I get in any trouble if i do this or someone finds out? Do you think that it is possible to get your H1 like this? Any help is greatly appreciated.

Thanks for your reply! I think I have some medical background so I will apply for masters in some medical programs. But, I like to jump to USMLE as soon as I come and can I not finish my current masters program at that university and pass my both USMLEs and start working at hospital? and apply for H1? is this legal? What would get me in trouble i m just trying to be careful?

Sometimes Hospitals will use H, J is much more common.

To maintain your legal status you will have to attend school full-time.

You can do USMLE on side that is not a problem, you will not be able to work for any hospital until you find a hospital that is willing to sponsor your work visa.

It is not just coz you pass USMLE you get H1, you need a employer who is willing to sponsor.

But your plan, as you describe it, would not be legal -- that's what would get you in trouble, no matter how careful you are at your plan. You propose applying for a student visa claiming you intend to be a full time student. You then would have to claim the same thing at the port of entry. Your actual plan appears to be to drop the school as soon as you possible can and start working -- clear misrepresentation as to your true intent/reason for entering the US.

If you are applying for an F-1 student visa, your intent should, and must be to come to the US to attend school. While the COs know that many students do eventually end up getting advanced degrees and lawful working permits through their F-1 visas, your intent still has to be to return to India upon completion of your studies, or at the very least to return eventually.

Simply put, you cannot get an F-1 visa (non-immigrant) if your intent is to immigrate.
