Hi Guys!just got a reply from my email inquiry last Jan.03 to NVC

Due to the numerical limitations on immigrant visa issuance prescribed by law, this petition is not eligible for further processing at this time.....

it means we really need to wait until our PD to be current inorder for the DS261 & online payment be activated.cray5ol.gif

If your husband going to apply for citizen then once he succeed , tell him to email NVC to change your category from F2A to IR1 from there you will be able to do tons of thing next and go to interview once case completed without having to wait till PD current.

After DS 261 ( Choice of Agent ) filled you'll need to fill DS 260 too along side paying AoS fee and send AoS documents ( I-864 )and paying IV fee and send IV documents ( Birth certificate..Marriage certificate.Photos..etc).

Hi Phillip,

Tnx for the response, was wondering if i could do the other processes uptill case complete while he applies next month so that this whole wait does not go in vain, especially when some applicants with petitions later than mine have been able to access Choice of agent and even made payments. All we have to do this watch and wait. i really dont understand fully this visa process at NVC. Here is an excerpt

After USCIS approves the petition, it is sent to the National Visa Center (NVC). Once received, the NVC will assign a case number for the petition. For family preference immigrant visa cases, when an applicant’s priority date meets the most recent qualifying date, the NVC will instruct the applicant to complete Form DS-261, Choice of Address and Agent. (NOTE: If you already have an attorney, the NVC will not instruct you to complete Form DS-261.) The NVC will begin pre-processing the applicant’s case by providing the applicant and petitioner with instructions to submit the appropriate fees. After the appropriate fees are paid, the NVC will request that the applicant submit the necessary immigrant visa documents, including the Affidavit of Support, application forms, civil documents, and more. Learn more about National Visa Center visa case processing.

I think because we used a law firm to file, they were automatically used as our choice of agent. Lets hope we would be allowed to access the necessary forms in time to come, as our priority dates draw closer.

Your lawyer is your attorney , i think NVC will not contact you ( it's automatically because you have attoreny ) 'bout DS-261 but soon they will address you for paying fee filling out DS-260 and send docs to them
