Why US-Kabul embassy has sent my IV case to US

Hi to all folks who are going trough the though AP process.

My wife had her interview on early August 2013, its been almost tow months and she is still under AP. Today she visited US-Kabul embassy to find out why her visa case was not updated since September 14, she was told that the embassy has completed the inquiry and has sent her case to US - no specific location given - for further process. My question is that which office is approving immigrant visas, the embassy, NVC or state department? And why would they send her case back to US? I have filed the petition for her on March 2012, I am so frustrated and tired of the never lasting process.

PS: I have contacted my Senator and Congressman's offices, they said its gonna take from 60 to 90 days for AP to be completed, when I see some people have been waiting for years, it scares me.

Help me understand the process.

The embassy approves or denies the case as far as issuance of the visa is concerned. Where is her passport? Was she given a 221 G form? What does it say?

It sounds like the case has been returned to USCIS in the USA. This is not good but we have to keep in mind this is an case concerning Afghanistan so this type of thing is to be expected.

Your politicians can do very little to help you in this situation but there is nothing wrong with asking them to do so. For example to say its going to be 60 to 90 days when they know nothing about the case is ridiculous.

You should contact the embassy again and ask why you are being sent back. Thats not AP. Thats a denial. More than likely a NOIR or NOID it goes to NVC than back to USCIS where USCIS will reaffirm or back up the NOIR/NOID and deny you.

It usually takes a few months to make it back thats why your congressman said 60 to 90 days.

Many especially out of Islamabad get sent back after a lengthy AP. I have a friend had 22 months in AP and they were sent back also. Just stay on top of your case and don't let up.

The embassy have not collected her passport yet and she was given a yellow sheet after a very simple interview, I believe it is the 221g, it still says the case is undergoing AP.

It looks like the case is in AP and they have sent to US to clear some red flags or something nothing to worry about. if they were to deny they would have informed you that they are sending the case back to US because they are denying it.

Had to change sponsor at last minute *during interview* and some issues with marriage certificate that made things complicated and possibly raised some red flags... there's nothing i can do about but just waiting since then.

Nothing to worry about? Clear some red flags? This sort of makes it sound like all is really ok if the O P just sits back and waits a little while things just take a few weeks to get straightened out.

These cases can take from months to even years to be resolved during which time the people will certainly worry because they will get absolutely no info about the status of the case.

They wont hide it if they are to deny the case. And I have contacted my congressman right after the interview while the case was still at embassy.

And your congressman has done what to resolve your case?

If the case is under AP there's nothing anyone can do to expedite the process i am waiting for the last 2 years, there's nothing you can do with AP other than sending enquiry through senator or contacting state department or the embassy itself and the answer you will get is the same from anywhere hence THERE IS NOTHING WE CAN DO ABOUT IT THIS IS HOW THE SYSTEM IS UNFORTUNATELY, if you get lucky you may get outta AP soon.

If the case is under AP there's nothing anyone can do to expedite the process i am waiting for the last 2 years, there's nothing you can do with AP other than sending enquiry through senator or contacting state department or the embassy itself and the answer you will get is the same from anywhere hence THERE IS NOTHING WE CAN DO ABOUT IT THIS IS HOW THE SYSTEM IS UNFORTUNATELY, if you get lucky you may get outta AP soon.

I have no idea why you directed this message to me. For one thing I am not in A P and have know the other info for years myself so don't need you to explain.

According to what you said the O P has nothing to worry about. Just a few red flags to clear up and all will be fine. Then you say to let these politicians help. Ridiculous advise.

You admit you have been waiting two years yourself. That should indicate to the O P what you are willing to do under the circumstance.
