Hi guys. I'm so incredibly confused right now. First, I hope I wrote this on the correct place. If I didn't, I'm sorry. So I need to know what forms are 100% required for the AOS. My fiance is here in the States now and we're getting married in a couple weeks and I was under the impression that the i485, i864, and g325a were the only documents required for the AOS. But I'm not understanding the employment authorization. Does this mean that if we also don't file the i765, he can never work here? I thought that once we did the first three I mentioned, he would receive his permanent residence visa and would be allowed to work as well. Is this not true? Note that it will take couple months to get green card and that could take up to a year to have it. However, that green card is conditional green card and only valid for 2 years. You need to remove the conditional to get your permanant resident card for 10 years.

I guess you can work even with 2 years green card. But you cant work before getting GC in your hand.

New Journey AOS:

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

He can work before getting green card, but he must have a work permit(EAD)just fill out form I-765 along with all other forms such as I-485,G325A(one set for you and one for him) and I-131 (optional).Filling out I-131 and I-765 along with form I-485 there is no extra fees for I-131 and I-765. Submit Copy of NOA2 as well."Approval" for I-129F .Here is the list of documents you need to submit.

The fees for the I-131 and I-765 are waived when filed with a pending I-485, so the AOS fee will be the same with or without those forms. You never know how long it will take for him to receive the green card, so he should file those 2 forms to be able to work and travel and re-enter the US while waiting for his green card. Of course you can work with the 2 year card. They will be a permanent resident no matter if their card expires in 2 or 10 years. It is indeed a permanent resident card. The 2 year card works exactly the same as the 10 year card. The only difference is that with the 2 year card, you must file to remove conditions within 90 days of it expiring.
