Hi,

My significant other will travel here from Japan for winter vacation soon on ESTA.

Is it ok to start the K-1 process while they're here? to eat into the K-1 process time and minimize the time we are apart?

They have return ticket and will go back after a few weeks.

Please advise

Thanks!

Hi another question,

Would it be easier if we just got married here in the USA on their stay and go for the I-130 when they are back home?

You can if you like - it's not easier, necessarily, but it is cheaper. Check out the comparison guide to see the pros/cons of the K1 versus the CR-1: http://www.visajourney.com/content/compare

It would probably take longer that way since spousal visas (CR-1) take longer than fiancee visas (K-1) do... At least that was the case a couple years ago. Look at the current K-1 vs CR-1 processing times...

And, there are other things to consider.. AOS vs. Green Card upon arrival, cost, etc...
