First, a little bit about my situation.

My wife came to USA on a K1 Visa with her son. We have been married for just over 2 years and their "2-year" Green Cards are set to expire next March.

I went to the USCIS website and found this:

"Conditional Permanent Residents are given a Green Card that is only valid for two years. Form I-90 should NOT be used to renew a Conditional Permanent Resident status.

Within 90 days of the two-year expiration date, Conditional Permanent Residents are required to file a petition to "remove the conditions" from their Green Card. If your conditional status was based on a marriage, you must file Form I-751, Petition to Remove Conditions on Residence. If your conditional status was based on being an investor, you must file Form I-829, Petition by Entrepreneur to Remove Conditions on Permanent Resident Status.

Once your petition is approved, you will receive a new Green Card, valid for 10 years. After that point, the typical renewal process (including Form I-90) should be used."

So my question is, do I only need to fill out the I-751 form for my wife and son and the conditional status will be removed AND they'll both get new 10-year Green Cards? I do not need to fill out the separate I-90 forms, correct?

Also, is there just the 1 filing fee and 2 biometrics fees? I do not need to submit a separate filing fee for her son correct?

Finally, I have to wait till I'm within the 90-day to expiration window before filing and cannot file sooner?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

1. You need to just apply for ROC using I-751 90 days before the expiry date of your wife's GC - some time in December. Can't file before 90 days window.

2. One applications for both wife and child - yes one application fee and 2 biometric fees to pay. Yes they will get 10 years GC, if approved.

3. No other forms to file except if you guys moved - the change of address needs to be filed using AR-11 (Immigrant wife & Child) and I-865 (USC), if he filed I-864.

Try to gather all the evidence that is needed right from now.

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Adjustment of Status after Marriage:

April 19, 2012 - Arrived in the USA on TN status working as a biologist

May 11, 2013 - Married USC

August 7, 2013 - Mailed AOS package (I-765, I-131, I485, I-130)

August 9, 2013 - Package received by USCIS

August 14, 2013 - NOA received for all 4 forms and checks cashed

Septemeber 11, 2013 - Biometrics Appointment

September 20, 2013 - I-485 Status changed to testing and interview

September 25, 2013 - Notification that interview has been scheduled for October 28, 2013

October 4, 2013 - Notification that I-131 has been approved!!!!

October 4, 2013 - Birthday updated on Form I-765

October 16, 2013 - I-765 EAD card in production!!!!

October 21, 2013 - I765- EAD and I-131 card has been mailed!

October 23, 2013 - EAD and AP combo card received and in hand!

October 28, 2013 - Greencard interview PASSED! Given an approved decision and told my greencard will be in the mail within 60 days!!!

November 6, 2013 - Conditional Greencard received in the mail and in hand at last!!!
