and went into effect Sept 5 2005. so what's your point?

not really recently to me, because i take recently to mean within the past year. it was signed into law 17 jun 05.

not really recently to me, because i take recently to mean within the past year. it was signed into law 17 jun 05.

A mere flutter of the eyelids in the Geological sense ;)

we're not rocks.

also note that: The law applies only to those convicted of capital murder on or after Sept. 1, 2005.

also note that: The law applies only to those convicted of capital murder on or after Sept. 1, 2005.

Of course its not retroactive - or the courts would be dealing with a flood of appeals on "closed" cases. Of course if there is an issue of unconstitutionality about the original law, then those cases should perhaps be revisited.

Here is another real doozie in the death penalty debate. I remember this a$$hole in the local news at the time. Kenneth Allen McDuff. He was convicted of capital murder in 1968 for an especially henious rape/ murder and sentenced to death. He got lucky in 1972 when a liberal US Supreme Court overturned all death penalties in the USA and his death penalty was commuted to a "life sentence" along with every other death row inmate in America. Incredibly this a$$hole was eventually paroled in 1989...proving that there is no such thing as a "life sentence" in Texas when politicians don't want to spend more money for more prison space to warehouse these animals.

He went on to be convicted of capital murder again in 1992 for a string of other murders and landed on Texas death row for a second time. Earning a dubious distinction of landing on Texas death row twice. Thankfully for the wellbeing and safety of the American public, the state of Texas finally got their sh!t together and sent this creep on a one way ticket to hell in 1998.

Certainly sounds like a travesty of justice that he was released. Still its a long way from justifying the death penalty on its own merits - the justice system is clearly flawed in certain respects, but I wouldn't suggest that putting people "beyond the reach of the law" is a reasonable fix for those flaws.

For me it only takes one innocent person to be put to death.

Yes it does - and that's really the issue. If you don't trust the judicial system to 'properly punish' offenders, the death penalty becomes little more than an easy option - rather than fixing the system itself.
