Hello, I am working a contract in Kuwait, My Fiancee is working a contract in Kuwait, but she is Romanian. Can we take leave for a month or so, go get married in the USA at my home, and then return to Kuwait to complete our contracts? How long does my Fiancee have to wait before she can travel out of the USA and back with out problems, Is there a form for that?? Any suggestions?

You can get married in U.S. and back to work in Kuwait. But, K-1 visa is not eligible for both of you anymore. It is spousal visa and what I read over here, CR-1/IR-1 takes longer rather than K-1 visa route. But I hope some others here can shed some of lights about CR-1/IR-1 (spousal visa) since I am K-1 visa filer not CR-1/IR-1 filer. Good luck.

I found the answer...Sorry, for asking before I searched around.

Note: A K-1 Visa holder can enter the United States only one time with this visa. Upon entry, the K-1 visa is cancelled, and the I-94 form issued upon entry becomes the controlling document. If the K-1 entrant leaves the U.S. before marriage to the original petitioner, re-entry into the U.S. might not be allowed without a new visa. Also, if the K-1 entrant has applied for and is waiting on approval of an Adjustment of Status petition, the K-1 entrant should not leave the U.S. without also having applied for and received approved Advance Parole -- doing so could result in the inability to re-enter the U.S., and it indicates abandonment of the petition for Adjustment of Status. (Note that even approved Advance Parole does not guarantee re-entry into the U.S.)

Yes, and getting Advanced Parole will take 3+ months.

How much longer to go on your contract? It may be better to delay the visa so you can finish, then immigrate to the USA.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

We have completed the paperwork, she completed the physical. I requested a interview date..was told due to heavy backlog of cases, there may be a two week delay till a date. My problem is our visa expires NOV 18 2013, and my wife is supposed to give a 3 month notice to resign..I dont think we will make it. She can still resign, but she will lose some of her retirement from the State Kuwait. We,would rather not have the visa expire, and have to start this process over again. So; we will just take it one day at the time.... :)

Wait... if you do not have an interview date yet, you have no expiry of a visa. Do you mean the petition will expire? That is no problem, the embassy will extend it. Once issued, the visa is usually valid for 6 months so your timeline should be fine for resigning after you successfully get the visa.
