It's interesting, dwheels76, isn't it? Another person on this forum found information saying that this new Division 8 will process "stand-alone" I-130s only. The assumption (and I know assumptions can be dangerous) is that stand-alones will NOT be sent to the local offices. Once the I-130 is adjudicated at Overland Park, KS, the paperwork will go directly to the NVC for the IR1/CR-1 and other family processes. Local offices (at least MY local office) are too busy processing ROCs and Naturalization/Citizenship paperwork.

So if you submit a package with an I-130, and AOS documentation, this package will NOT go to Overland Park. Just those of us starting the process for our loved ones with the I-130 only.

And...it appears that from May 2013 onward, most stand-alone I-130s have been held pending the opening of Overland Park, KS, Division 8. Depressing, isn't it?

Does anyone have a STANDALONE I-130 submitted from May 1st onward with any movement on it? My NOA1 has the Overland Park address....

They've changed their process twice now since August 2012. I'm sure the sequester in January 2013 has not helped ANY of us!

Very interesting indeed. I have heard from many filing since that May mark yes they are holding everything not adjudicating just waiting for the launch at end of month.

I know many who filed in January and February and their local offices have been horrible. Files sitting waiting for interviews that never got scheduled, My friend had an petitioners interview for June no one even let her know. This after 2 service request and 2 INFOPASS. Here it is September and she is waiting fro the interview still.

Another friend at Atlanta (now that's a real hot mess) took 12 months for NOA2. She got that in July and guess what her file still hasn't made t to NVC then sent it by accident to NRC (now that has happened a few times).

It's just been horrific. I really fell for everyone. I am trying to get as much information as I can and report back. Hang on people.a change is coming.

oh yes a change is coming and it will be total chaos here on VJ just like it was when the whole 129 fiasco was taking place earlier this year.. I would expect to see a huge number of recent petitions come through with approvals before those old ones, and of course the imminent transfers that I am sure will take place

Thanks Stevie b, Yes probably best to just let it ride. So far I haven't read of anyone sending in a 129 along with 130. Wasn't the whole idea behind the 129 to keep the separation between husband and wife to a minimum!!!!!

Back in the day (like 5 to 6 years ago) when I-130's were taking 2 to 4 years to be done K3's were the way to go. Now a K3 buys you nothing. Thats why they are going to take it off the books.

It use

to be they just administratively close the I-129F when it gets to NVC before the I-130. Now they marry them up which means which every petition is moving slower you are waiting. (I don't think they even know what they doing). It suppose to be what ever got to NVC first you were to make decision which route to continue with that or wait for other. now they making the decision for people.

Every year whether its a I-130 or a I-129F depending on whats happening with immigration, politics and whatnot the service centers get affected. Badly.

Look at what the sequestering did to the government in April. Cut staffs in half and you could tell because that's when everything came to a crashing stop. I-129F's aren't flyin through, I-130's aren't either. We are at the mercy of the ebb and flo of government and lack of bodies that can do the job.

And after the USCIS nightmare wait you have NVC which I pray by the time you all get there all the bugs are worked out. It use to be at worst a 21 day process. The record is actually 11 days. Heck in 2011 I thought I could break it, than my file was lost after NOA2 for 30 days. So I do feel all your pain.

I'm trying to see if the country matters.... like if the high fraud countries are sent to the field offices for extensive background checks... its just a thought.. becuase my lawyer told me that come cases were getting sent to field offices for more work to be done on them.... maybe that is what he meant... I'm just thinking outloud....

Just curious.... what contry was the beneficiary from that went to Atlanta? I'm really pissed at all the confusion the USCIS is creating.. I'm trying to see if the country matters.... like if the high fraud countries are sent to the field offices for extensive background checks... its just a thought.. becuase my lawyer told me that come cases were getting sent to field offices for more work to be done on them.... maybe that is what he meant... I'm just thinking outloud....

country has nothing to do with the field offices.. it has to do with where the petitioner lives

uscis will ensure the file is complete and will do limited background checks, nvc is where the more extensive background checks will occur as I understand it

One beneficiary from Costa Rica and one from Pakistan or Iran ( for example sake) I was thinking maybe the high fraud file would goto the Field office and the other would stay at the NBC... Im just trying to make sense in my head.... Probably impossible LOL

Nope Atlanta field office had to do with they were bombarded. Didn't matter the country. In fact they have a thread

Yes some petitions went to NBC and just got adjudicated there. Why who knows. I know some from all over the country just stayed there. I know some all over the world still there as we said since even march. Some go to field office. Who knows but its not a country thing.

I could not agree more. You nailed it.

Being in the relationship for more than 5 years by now give my fiancé and I a perspective the whole meaning of life that what we would going through in the future. We've been in long distance relationship for years which is many people still don't understand how to worked it out. If we could make this relationship works for 5 years and now still on why can't we just wait for less than a year for the whole process to be done?

I feel the same. Most "normal" couples don't understand and could never get through the ####### we here on visajourney have to go through. Their love just isn't strong enough in my honest opinion. The whole process is terrible, but it makes a couple's love so much stronger and makes them dependent on each other in a very close and loving way. In fact, it's a blessing in disguise in many ways. You're ask exactly the right question at the end. Very well said as well. :)

I'm not very knowledgeable about all this yet....maybe in a year of dealing with the delays I will be lol.

Are all I130 sent to NBC? Or only stand alone files? Are I130 sent with adjustment 485 forms sent to NBC too?

Reason I ask is I was checking up random MSC case numbers around mine. I see approvals on I130 from end June to early July. My PD is July 5. So how come those are approved? Or can those be cases where it's not stand alone I130 and case was transferred to a local office that was fast?

Just trying to understand.....

This approvals could be for LPR spouses, it looks like there was a rush of those being approved before the end of the fiscal year.

That is interesting that you say that the USCIS slowed down because of the sequester. I read on another thread that the USCIS was funded by the fees collected and therefore not affected by the sequester mandated cuts in funding. Anyway, I find it ironic that the very word "sequester" means to "kidnap", which is what seems to have happened to many applications !

I'm trying to see if the country matters.... like if the high fraud countries are sent to the field offices for extensive background checks... its just a thought.. becuase my lawyer told me that come cases were getting sent to field offices for more work to be done on them.... maybe that is what he meant... I'm just thinking outloud....

Search here for a question and answer session with a former USCIS adjudicator....I don't have the link at my fingers but search "adjudicator q and a" by HUSKERKIEV. It is from back on 2007, but he states that country of origin had nothing to do with how cases were processed at the USCIS level. Maybe later at the NVC or Consulate, but not at USCIS.

From what I understand, most cases that were acknowledged as being at NBC were actually sent to local field offices for adjudication. You would not know that unless you spoke to a Tier 2 rep at USCIS.

Back in the day (like 5 to 6 years ago) when I-130's were taking 2 to 4 years to be done K3's were the way to go. Now a K3 buys you nothing. Thats why they are going to take it off the books.

It use

to be they just administratively close the I-129F when it gets to NVC before the I-130. Now they marry them up which means which every petition is moving slower you are waiting. (I don't think they even know what they doing). It suppose to be what ever got to NVC first you were to make decision which route to continue with that or wait for other. now they making the decision for people.

Every year whether its a I-130 or a I-129F depending on whats happening with immigration, politics and whatnot the service centers get affected. Badly.

Look at what the sequestering did to the government in April. Cut staffs in half and you could tell because that's when everything came to a crashing stop. I-129F's aren't flyin through, I-130's aren't either. We are at the mercy of the ebb and flo of government and lack of bodies that can do the job.

And after the USCIS nightmare wait you have NVC which I pray by the time you all get there all the bugs are worked out. It use to be at worst a 21 day process. The record is actually 11 days. Heck in 2011 I thought I could break it, than my file was lost after NOA2 for 30 days. So I do feel all your pain.

I just read this post. 2 to 4 years to process an I-130???!!!! That's terrible!!! Do you think it could ever get that bad again now? I really really am hoping it isn't that bad, as we have a baby on the way and I will literally lose my mind if I'm separated from my wife and child for 2 to 4 years. :(
