I noticed a question on the I-129f form which asks had I ever filed for and immigration benefits on for another immigrant before (sorry, I can't quote exact at the moment). Here is my thing; my ex did an in-country AOS after overstaying a visitor visa by marriage. I can not for the life of me remember the EXACT date he got his conditional residence, only that is was sometime the end of Dec. 2008. He then joined the military and skipped right up to citizen via military service and naturalized on 8/9/2010. Never had the 10yr. card.

Since he didn't get the citizenship from me in any form, do I just list the date he got the conditional residence or still put naturalization date? And how would I find out the exact date it was given on? I asked my ex since we are civil and he can't even remember an exact date himself, but has a good guess of Dec. 29. Will it mess things up if I put 12/29/2008 and it turns out to be off by a few days? I know his old A # and everything else just no exact date!

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

NOA1: March 21, 2016.

Biometrics: April 20, 2016.

RFE Initial evidence: April 21, 2016 for birth cert/translation and Q1/B1 i94s

RFE response received: May 10, 2016.

EAD approval: May 25, 2016- Card arrived at attorney's office! Could not pick up until May 30 because we were at Disney World again :):D

Notice of missing medical exam: July 2016 (Done on purpose to avoid expiration, we will bring it to the interview as stated in notice)

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

I was wondering about putting that on an additional sheet, or perhaps writing o/a on the margin of that question. Ugh I hate that I know exact dates for everything but this.

Did you file an I864 for his AOS? If he was already here and filed AOS on his own without your help my thoughts would be that you are not connected to his AOS. What type of visa did he adjust from? If it was not a fiancee or spousal visa then I don't think you have a previous petetion. Those are only my thoughts along a logical line of reasoning. Maybe Hank or some other guru can chime in here and correct me if I am mistaken.

My ex overstayed a visitor visa by 12yr (he came as a teenager)....he did adjust by marriage to me inside the USA, had the interviews, etc. It is possible, and I know I'm connected to him in that aspect so I have to list it. I am wondering if I can call USCIS and just ask since I know the A# or make an infopass.

If not I'll just send in an extra sheet with the explanation unless I find a way to get that exact date.

Good news, I found the date on a really old photocopy of my ex's conditional green card I kept for records!

Now I still need to know if I put the date he got the green card as the benefit, or the citizenship date? I'm confused since he naturalized by military service, it was filed by the Army for him due to serving in a time of war and nothing to do with marriage. I think I only list the date he got the green card since it was the only thing I petitioned for....right?
