You can start it now. I assume you want to return to Thailand for some reason? Because if not, getting married and filing for Adjustment of Status is another option, but it would mean you could not leave the USA for a few months after marriage.

Bye: Penguin

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

hiii congratulation I was an au pair too and met the man of my life while being an au pair ? here goes a smart advice from someone who made a big mistake and left the usa to try to live and married abroa woth mt hubby ! best option is to start to apply as soon as ur year is over of course start before that to get all the paperwork together then apply u wont be illegal while your case is pending ! I would say go for adjustment of status is the fastest and better way to be together and never separate also just in case check your visa if it says two years requirement it means you are not allowed to stay inthe usa when ur au pair year is done if it doesnt then u r luxky :) I could tell you a bunch of things but smart advice stay in usa girl I left nd now im paying for.it waiting to.get approved 6 months ago :( good luck and read a lot to not mke mistkes

Thanks for your anwers .Yea I know marriage is better but it just feels rush.K1 is a safe way to keep him with me

huh? k1 visa folk must interview at a consulate, never in the USA.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

I think she means she wants to go thru the K 1 process to stay connected to the fiancé rather than get married in a rush. This is understandable when we include the Thai culture aspects.

You might want to google "J-1 two year home residency requirement thailand"

Not sure if you fall into that category or not. If you do, you'll need to get a no objection letter from some agency in Thailand releasing you from that requirement. Read this as well: http://www.travel.state.gov/visa/temp/info/info_1288.html

MiiMo-MeLon is a member here that went through this in the last year from Thailand. Here is a thread relating to that:

I believe he can send the K 1 petition in no matter where you are at that time. It just means you must be in Thailand to interview for the visa. Do not over stay you present visa.

The other option is as Penguin says. Stay and marry. But if you need time or want to return to Thailand and your family, plan on being there about 6 to 9 months.

oh well if is about culture then I recommend k-1 visa I mean processing times goes up everytime but I've heard that you get approved in three months only problem is that you have to be his fiance and get married in USA because if you get married in thailand you wikk have to apply for either k3 visa or CR visa and believe me is a longgg wait ! but good luck and follow your heart you guys will do great!

I've never reported a post unless it was to have it moved to the proper forum. But carry on with your delusions and inaccurate immigration advice.

Echo: Is a pile of inaccurate immigration advice.

How to solve? I have ideas, but most of them get me incarcerated for violence against another human. I don't want that, and neither should you.

Agree !

But - forget google for the moment.

Crack open yer passport, take a look at the J-1 visa.

Any coding in there, that has 'HRR' or 'H.R.R.' in it? If so, please write out the entire line here, in a new post, and we can tell you what's what.
